A. Definitions: As used in this section, the following words and terms shall have the meanings ascribed to them in this subsection:
STREET: Any public street, avenue, parkway, boulevard, drive, lane, circle, alley, court, place or any other public highway within the Village.
VEHICLE: Every device in, upon, or by which any person or property is or may be transported or drawn upon a public highway, except devices used exclusively upon stationary rails or tracks.
B. Declaration Of Emergency: Whenever in the opinion of one of the following: the Chair of the Streets and Alleys Committee of the Village Board, the Engineer for the Village or the Village President, an emergency exists or is imminently forecast in the Village, or in a section or sections thereof, because of snow, freezing rain, sleet, ice, snowdrifts or other natural phenomena which create hazardous road conditions impeding or likely to impede the free movement of fire, health, police, emergency or other vehicular traffic; the cleanup of snow, freezing rain, sleet, ice, snowdrifts and other natural phenomena; or the safety and welfare of the community, any two (2) of the aforesaid officers may declare a snow emergency to exist for a period of seventy two (72) hours. Said declaration of emergency shall be released to the public information media prior to its becoming effective. (1984 Code § 10-3-2)
C. Designation Of Snow Emergency Routes: By resolution, motion or ordinance, the Village Board of Trustees may designate certain streets, or portions thereof, as snow emergency routes, and all such streets shall be posted with suitable signs or markers at intervals not exceeding five hundred feet (500'), which signs or markers shall bear the words "Snow Emergency" and also indicate where parking would otherwise exist and that parking is prohibited during a snow emergency.
D. Placement And Maintenance Of Signs: The Trustee of Public Works shall place and maintain all snow emergency signs or markers required under this section.
E. Parking Prohibited On Snow Emergency Routes Or Other Designated Streets:
1. Upon the declaration of a state of emergency, the Trustee of Public Works, the Engineer for the Village or the Village President may prohibit during the emergency the parking, standing, or leaving of any vehicles upon any or all the snow emergency streets designated herein. The emergency declaration provided for in this section may be extended to streets other than those designated as snow emergency routes. (1984 Code § 10-3-2; amd. 2010 Code)
2. Parking may be resumed on individual streets upon termination of the emergency weather condition as soon as final plowing, as announced, has been completed on that street.
F. Penalty: If any vehicle is parked, abandoned, or left standing in violation of the terms of this section, the same shall be considered a hazard and may be removed and impounded. The owner of such vehicle shall be liable for all costs, fees, and charges arising from such impounding. (1984 Code § 10-3-2)
