§ 50.999 PENALTY.
   (A)   Any person who shall continue any violation beyond the time limit provided for in § 50.008 shall, upon conviction thereof, be fined in an amount not less than $1,000 per day, per violation, in accordance with 40 CFR 403.8(f)(l)(vi)(A) but not more than $2,500 per day, per violation for a first violation nor more than $7,500 per day, per violation for subsequent violations, in accordance with IC 36-l-3-8(a)(10)(B). Each day in which any such violation shall continue shall be deemed a separate offense.
   (B)   Any person violating any of the provisions of §§ 50.005 through 50.008, 50.020 through 50.028 and 50.040 through 50.059 shall become liable to the town for any expense, loss or damage occasioned the town by reason of the violation.

   (C)   A person who violates § 50.009 commits an ordinance violation. A judgment of up to $2,500 may be entered against a person who commits a violation under § 50.009. Each day of violation constitutes a distinct and separate violation.
