1311.02 FILE AND DISTRIBUTION COPIES.
   One copy of the National Building Code adopted in Section 1311.01 is on file at the office of the Clerk of Council for use and examination by the public. In addition, the Clerk of Council has copies of the National Building Code available for distribution to the public at cost. One copy is also on file in the County Law Library.
1311.03 CONFLICT OF LAWS.
   The adoption of the National Building Code shall not repeal, abrogate, annul or in any way impair or interfere with existing provisions of other laws or ordinances. Where such Code imposes a restriction in conflict with a statute of the State upon the same subject, the provisions of the statutes shall control.
1311.04 DEFINITIONS.
   (a)   Wherever the word “Municipality” is used in the National Building Code, it means the Municipality of Sebring, Ohio.
   (b)   Wherever the term “Corporate Counsel” is used in the National Building Code, it means the Solicitor of Sebring, Ohio.
   (c)   Wherever the term “Building Official” is used in the National Building Code, it means the Building and Zoning Official of Sebring, Ohio or his designated representative.
1311.05 BUILDING PERMITS AND FEES.
   (a)   Before any permit is issued for construction, repair or alteration, the Building and Zoning Official will notify the Finance Director that the proposed construction meets the requirements of the Zoning Ordinance.
   (b)   After the Finance Director has been notified that the proposed construction meets the requirements of the City Zoning Ordinance and before any permit is officially issued for the proposed construction or alteration of any structure within the City, all required State permits must be presented and the following fees paid to the Finance Director:
(1)   All applications:
 
   Residential
$25.00
   Commercial, Industrial
$50.00
(2)   Residential construction or
   alterations:   
$10.00 per $1,000.00 for first $5000.00 of valuation - plus $4.00/$1000 valuation for each additional $1000 of valuation
(3)   Commercial, industrial
   construction or alterations:
$100.00 for first $5000.00 of valuation - plus $5.00/$1000 valuation for each additional $1000 of valuation
(4)   Demolition of building:
$50.00 - Less than 1000 square feet
(5)   Demolition or moving of
   buildings:
$250.00 over 1000 sq. ft.
(6)   Hazard material installation,
   removal or periodic inspections:
$250.00
   (c)   Completion Date of Construction or Alterations:
      (1)   Residential: Six months from date permit is issued.
      (2)   Commercial or industrial: Twelve months from date permit is issued.

1311.06 RIGHT OF ENTRY.
   The Building and Zoning Official, in the discharge of his official duties, and upon proper identification, shall have authority to enter any building, structure or premises at any reasonable hour.
1311.99 PENALTY.
   (a)    Whoever violates any provision of the National Building Code adopted herein shall be punished as provided in Section 106 "Penalties" of the National Building Code, 1976 Edition.
   (b)    Whoever constructs, repairs or alters any building or structure without obtaining a permit and paying the fee therefor as provided in Section 1311.05, is guilty of a minor misdemeanor.
   (c)    The imposition of one penalty for any violation shall not excuse the violation or permit it to continue and all such persons shall be required to correct or remedy such violations or defects within a reasonable time and when not otherwise specified, each day that the prohibited conditions are maintained shall constitute a separate offense.
   (d)    The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
