(A) Except as provided with more specific penalty provisions as set forth below, any person who shall violate or fail to comply with the enforcement of any of the provisions of this chapter set forth at full length herein, or incorporated by reference, shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined not more than $500 plus liquidation fees and impound fees for each offense. A new violation shall be deemed to have been committed every 24 hours of the failure to comply.

(1) First violation - $50 fine;
(2) Second violation - $100 fine;
(3) Third or subsequent violation - forfeiture of animal as per § 90.26; and
(4) Violations are computed during a two-year period.

(5) Alternatively the city may file such violation in the form of a complaint in the County Court of Colfax County, Nebraska, requesting the fines as set forth above or as determined by the Court, together with liquidation fees and impound fees for each offense and forfeiture of the animal as per § 90.26.

(F) Any person, upon violation of the provisions of §§ 90.41, 90,42, 90.43, 90.44, 90.46, 90.47, 90.48, 90.49 or 90.54, who should fail, neglect, or refuse to comply with any of the provisions of §§ 90.41, 90,42, 90.43, 90.44, 90.46, 90.47, 90.48, 90.49 or 90.54, shall be in violation of §§ 90.41, 90,42, 90.43, 90.44, 90.46, 90.47, 90.48, 90.49 or 90.54, as applicable, and shall be required to pay a fine to the city without further prosecution in court as follows, to-wit:
(1) First violation - $100 fine;
(2) Second violation or subsequent violation the city may file a complaint in the County Court of Colfax County, Nebraska and the city may initiate administrative proceedings to declare the owner a reckless owner pursuant to § 90.53.
(G) In addition to the foregoing fines, any person coming within the penalty provisions of this section shall be obligated to pay all liquidation fees of the animal and all impound fees relating to the animal. Said impound fees shall be set by resolution of the City Council, and such liquidation fees shall be the actual expenditures for the liquidation of such animal. Further amendments to the fine provisions under divisions (B), (C), (D), (E) and (F) above as well as the impound fees may be amended or revised by resolution of the City Council.
