(A) Dog or cat.
(1) It shall be unlawful for the owner of any animal to allow their dog or cat to run at large, whether licensed or not, or to go in and upon the private premises of others within the city or upon the streets or property of the city except when accompanied by and under the control of the owner or a member of his or her immediate family and on a leash as defined by § 90.01. It is further declared unlawful for any owner of any female dog or cat; whether licensed or not, to allow the female animal, while in heat, to run at large or be kept outside of a closed building, tightly fenced yard, or suitable means of confinement. Any dog or cat found to be running at large shall be impounded by the Animal Control Officer as provided in this chapter. The officer shall not release the animal until the shelter fees provided for hereinafter are paid. However, more strict provisions shall also apply to dangerous or potentially dangerous dog violations as provided in §§ 90.40 through 90.55.
(2) All dogs shall be kept under restraint. This means either under a leash when off the owner's property as provided for in division (A)(1) above, or shall be within a tightly fenced yard, or shall be chained or leashed within a yard, or in another suitable means of confinement when on the owner's premises. Subject to the more strict provisions under the dangerous dog sections, §§ 90.40 through 90.55, the only exception to the restraint requirement shall be if the dog is outside on the owner's premises, and is being supervised by a responsible member of the owner's family who is also outside at the same time.
(B) Livestock, fowl, and exotic animals. The running at large or herding of any horses, cattle, or other such animals commonly known as livestock, or the picketing or tying out of any such animals upon or in any public street or other public or private grounds in the city not owned by or under the lawful control of the owner or person in charge of the livestock, or the running at large of any chicken pigeon, or other fowl or animal, whether domestic, wild, or exotic, within the city is hereby declared to be a nuisance and is hereby prohibited.
