§ 90.26 MULTIPLE VIOLATIONS; NUISANCE; PENALTIES.
   (A)   Any owner of any animal regulated by this chapter who fails repeatedly to care for or control the animal and has been issued warnings or citations for violating one or more provisions of this chapter on three or more occasions within any 24-month period, shall be deemed to be maintaining a nuisance, the abatement of which shall be the forfeiture of the animal or animals in violation. More strict provisions shall also apply to dangerous or potentially dangerous dog violations of a reckless owner as provided in the dangerous dog provisions in §§ 90.40 through 90.55.
   (B)   The owner of any animal found in violation of this chapter shall be responsible for all costs incurred by the city in connection with the apprehension, housing, care, or destruction of that animal.
   (C)   Any person who shall violate the provisions of this chapter shall be subject to the penalties, liquidation fees and impound fees contained in § 90.99, as amended.
