For the purpose of this chapter, the term “nuisance” is defined to mean any use or condition of use of a parcel of land or premises or of building exteriors which is detrimental to the property of others, and/or the health and welfare of others, or which causes or tends to cause substantial diminution of the value of other property, and/or diminution of health and welfare of the citizens in the neighborhood in which said land or premises is located. This includes, but is not limited to, the keeping or the depositing on or the scattering over the premises of any of the following:
A. Lumber, junk, trash or debris.
B. Abandoned, discarded or unused objects or equipment, such as automobiles, parts of automobiles, furniture, stoves, refrigerators, freezers, cans or containers.
C. Trailers, machinery, implements of husbandry, or any other equipment or items not common to the neighborhood in which the premises is located. (Ord., 3-31-2008; amd. Ord., 9-30-2019)
No person owning, leasing, occupying or having charge of any premises shall maintain or keep any nuisance thereon, nor shall any person keep or maintain such parcel of land or premises in a manner causing substantial diminution to the value of other property in the neighborhood or diminution of the health and welfare of the citizens in the neighborhood in which such parcel of land or premises is located. The village marshal or any person so designated by the village president and board of trustees is hereby authorized to abate any violation hereof and may enter upon private property at all reasonable hours for the purpose of inspecting such nuisance, and posting notice and abating the nuisance. The person owning, leasing, or occupying the property shall be given seven (7) days to abate the nuisance. If the owner or custodian has not abated the conditions within seven (7) days of the date notice is provided, the Village may abate the nuisance. The person owning, leasing, or occupying the property shall be responsible for all cost of such abatement and shall reimburse the Village of Scales Mound for all cost borne by the Village to enforce the conditions of this chapter.
