10-3-1: CREATED; MEMBERSHIP; APPOINTMENT:
A planning commission is hereby created. It shall consist of five (5) appointive members, all of whom shall be citizens of the city. The mayor shall serve as ex officio member of the planning commission. The five (5) appointive members shall be appointed by the mayor, subject to confirmation by the city council, and shall serve for terms of three (3) years, or until their successors take office. Of the original appointive members, however, one shall serve a term of one year, two (2) shall serve a term of two (2) years and two (2) shall serve a term of three (3) years. Thereafter the terms of members shall be three (3) years. Vacancies occurring other than by expiration of the term shall be filled for the unexpired terms. The members shall serve without compensation. The city council may remove a member of the planning commission only for inefficiency, neglect of duty, or malfeasance in office. Members shall be appointed solely with reference to their fitness and not party affiliation. Ex officio members shall receive no compensation for their work on the planning commission other than the fixed salary of the office. (1989 Code § 12-101; amd. 2002 Code)
10-3-2: QUORUM:
Three (3) members of the planning commission shall constitute a quorum for the transaction of business; provided, however, that no action shall be taken which is binding upon the planning commission, unless concurred in by not less than a majority of all members comprising the planning commission. (1989 Code § 12-102)
10-3-3: ORGANIZATION:
The planning commission shall elect a chairman, a vice chairman and a secretary and may create and fill such other offices as it may deem necessary. The term of the chairman, vice chairman and secretary shall be one year with eligibility for reelection. The planning commission shall hold at least one regular meeting each month. The planning commission shall adopt rules for the transaction of business and keep a record of its regulations, transactions, findings and determinations, which record shall be a public record.
