(a) Residential Fencing.
(1) Front Yard Fencing. Front yard fencing extending byond the front line of the structure shall:
A. Be limited to no higher than four (4) feet; and
B. Have a void of at least fifty percent (50%) up to four (4) feet so that a four (4) foot high picket fence shall have a picket to void ratio of 2:1 or greater.
(2) Side and Rear Fencing. All side and rear yard fencing located behind the front building line shall:
A. Be limited to no higher than six (6) feet above the undisturbed grade.
B. Side or rear fencing may have a solid screen up to six (6) feet.
(3) No barbed wire may be used in the construction of or in addition to any residential fence.
(b) In all commercial and industrial districts, fences ten (10) feet or less in height, above the undisturbed grade, may be located and erected on any part of a lot or parcel. Barbed wire shall only be used in the construction of the topmost section of the fence.
(d) Other Fencing Design Standards.
(1) All fencing along adjacent lot lines shall be constructed so that:
A. On lots or parcels of single ownership abutting fences are prohibited. When replacing fencing, the existing old fence must be removed.
B. The property owner or agent is responsible for determining the location of all property lines.
(2) All fences shall be constructed so that the finished side faces adjacent property or any public right of way.
(3) Fences shall be constructed out of any of the following materials:
A. Wood or vinyl simulating wood.
B. Wrought iron or aluminum simulating wrought iron.
C. Stone, brick, concrete with stone or brick veneer, or pre-cast concrete simulated stone or brick.
D. Chain link or vinyl clad chain link, in the rear or side yard only with a maximum height of four (4) feet in all districts except commercial and/or industrial.
E. No cedar slat, plastic or woven wire fencing are permitted.
F. Other materials not specifically listed above that are typically used for fencing or walls may be used upon the written approval of the Zoning Officer.
(e) Fencing Surrounding Swimming Pools.
(1) All in-ground swimming pools and above-ground pools less than four (4) feet above grade shall be completely enclosed by a fence and/or permanent structure erected along the periphery of the pool.
(2) All fence openings into the pool area are enclosure shall be equipped with self-closing and self-latching devices. The fence and gate shall not be less than four (4) feet and not over six (6) feet in height above ground level, commencing at grade level and extending vertically.
(3) All fences constructed and maintained in accordance with this section shall also comply with all other requirements of Section 1194.01
.
(4) All fences shall be kept in good repair and be maintained in safe condition.
(5) Finished or good side of the fence shall be placed facing out.
(6) When an above -ground pool structure four (4) feet or higher above grade level is used as a barrier or where the barrier is mounted on top of the pool structure, and the means of access is a ladder or steps then:
A. The ladder or steps shall be capable of being secured, locked or removed to prevent access and shall be secured, locked or removed when the pool is unattended; or
B. The ladder or steps shall be surrounded by a fence which meets the requirements of this section.
