The provisions of this chapter shall apply to and control the installation of gates, barriers or other control devices to restrict vehicular or pedestrian traffic through alleys as authorized by Section 21102.1 of the California Vehicle Code. This chapter shall not apply to or affect any closure or abandonment of a street or alley pursuant to any other provisions of state law or this code. (Prior code § 38.17.250)
The city council may adopt a resolution authorizing the restriction of vehicular or pedestrian traffic through any alley or alleys pursuant to this chapter by means of gates, barriers, or other control devices, when the city council finds that such restriction is necessary for the protection or preservation of the public peace, safety, health, or welfare. (Prior code § 38.17.251)
Any restriction of vehicular or pedestrian traffic authorized pursuant to Section 12.40.020 of this chapter shall remain in effect for such period of time as specified in the city council's resolution authorizing such restriction, or if no time period is specified, until the city council finds that such restriction is no longer necessary for the protection or preservation of the public peace, safety, health, or welfare.
