(A) There is hereby created an agency of the village to be known as the Village Emergency Management Agency (EMA) to prevent, minimize, repair and alleviate injury or damage resulting from disaster caused by enemy attack, sabotage or other hostile action, or from natural or a human-made disaster, in accordance with the State Emergency Management Act.
(B) The Village EMA created pursuant to this chapter supersedes any civil defense agency or emergency service and disaster agency heretofore created by the village, including the Village ESDA heretofore existing, the powers, functions, personnel and assets of which are hereby transferred to the Village EMA created hereby.
(C) The Village EMA shall consist of the Coordinator, Deputy Coordinator, Assistant Coordinators and other such technical, clerical and other administrative personnel as may be selected by the coordinator with the approval of the Village President or Village Administrator, and may make such expenditures within their appropriation therefore as may be necessary to carry out the purpose of this chapter.
(D) The Village EMA shall have jurisdiction over and serve the entire village, village property not located within the corporate limits of the village, and with the approval of the Village Board of Trustees, any other area which may decide to contract with the village for emergency management assistance.
(E) The Village Fire Department, by agreement with the village, shall perform the duties of the Village EMA and the Coordinator, Deputy Coordinators and Assistant Coordinators shall be comprised of active members of Village Fire Department.

(A) (1) The Fire Chief of the Village Fire Department shall serve as coordinator of the Village EMA. The Fire Chief shall serve as Coordinator until his or her successor is appointed and qualified.
(2) The Coordinator established pursuant to this chapter shall have a term of office commencing on 6-20-2010; until that time, the current Coordinator shall remain in office.
(B) The Coordinator shall have direct responsibility for the organization, administration, training and operation of the Village EMA as prescribed in the village’s emergency preparedness plan subject to the direction and control of the Village President. He or she shall coordinate the activities of all organizations for emergency management operations within the area served by the Village EMA and shall maintain liaison and cooperate with the emergency management agency of the county.
(C) In the event of the absence, resignation, death or inability to serve of the Coordinator, the Deputy Coordinator, or his or her designee, shall be and act as Coordinator until a new appointment is made as provided in this chapter.

(A) The two Deputy Fire Chiefs of the Village Fire Department shall serve as Deputy Coordinators of the Village EMA. The Deputy Fire Chiefs shall serve as Deputy Coordinators until his or her successor is appointed and qualified.
(B) The Deputy Coordinator shall act under the direction of the Coordinator in regards to daily and emergency functions.
(C) In the event of the absence of the Coordinator, the Deputy Coordinator shall be and act as Coordinator with direction of the Village EMA.
(D) In the event of the absence, resignation, death or inability to serve of the Deputy Coordinator, the Senior Assistant Coordinator, in regards to time served, shall be and act as Deputy Coordinator until a new appointment is made as provided in this chapter.

(A) The Assistant Coordinators of the Village EMA shall be selected and appointed from among the active officers/members of the Village Fire Department by the Village EMA Coordinator. The Assistant Coordinators shall serve at the pleasure of the Village EMA Coordinator. The Assistant Coordinators will be limited to three positions.
(B) The Assistant Coordinators shall act under the direction of the Coordinator in regards to daily and emergency functions.
(C) In the event of the absence of the Coordinator and the Deputy Coordinator, the highest ranking Assistant Coordinator, in regards to seniority of time served, shall be and act as Coordinator with direction of the Village EMA.

The Village ESDA shall:
(A) Prepare and keep current a disaster emergency plan for the Village EMA;
(B) Interrelate with business, labor, industry, agriculture, civic and volunteer organizations and community leaders in the development of such plan;
(C) Prepare and distribute to all appropriate officials in written form a clear and complete statement of the emergency responsibilities of all local departments and offices and of the disaster chain of command;
(D) Cooperate with all other emergency management agencies;
(E) Establish, train and maintain such communications unit(s) as may be deemed proper by the Village Board of Trustees;
(F) Establish, train and maintain such other volunteer EMA units as may be deemed proper by the Coordinator or Village President to place the village in a position to promptly and efficiently respond to disaster;
(G) Prepare, for issuance by the Village President or Board of Trustees, resolutions, proclamations and regulations as necessary or appropriate in coping with disaster;
(H) Cooperate with the federal, state and county government and any public or private agency or entity in achieving any purpose of this chapter and in implementing programs for disaster prevention, preparation, response and recovery; and
(I) Do all other things necessary, incidental or appropriate for the implementation of this chapter.

(A) (1) A local disaster emergency may only be declared by the Village President or his or her interim successor, as defined in the Emergency Interim Executive Succession Act, 5 ILCS 275/1. For purposes of such act, the interim successors are hereby designated as follows:
(a) First, the Village Trustee that has been designated as Mayor pro tem;
(b) Second, the Village Trustee with the next most seniority on the Village Board; and
(c) Third, the Village Trustee with the third most seniority on the Village Board.
(2) In case two Trustees have equal seniority on the Village Board, the identity of the interim successor shall be decided by agreement or, if no agreement can be reached, by lot.
(B) A local disaster emergency shall not continue for a period in excess of seven days, except by or with consent of the Village Board of Trustees. Any order or proclamation declaring, continuing or terminating a local disaster emergency shall be given prompt and general publicity and shall be filed promptly with the Village Clerk.
(C) Such declaration(s) of a local state of emergency shall constitute a declaration, of a local disaster pursuant to 20 ILCS 3305/11, the effect of which is to activate the emergency operations plan of the village and to authorize the furnishing of aid and assistance under that plan or any other applicable plan.
(D) Orders authorized. After the proclamation of a local state of emergency, the Village President may, in the interest of public safety and welfare and to address issues threatened by the emergency, take any or all of the following actions by executive order during the state of emergency:
(1) All actions reasonably necessary to respond to the disaster;
(2) A general curfew applicable to such geographical areas of the village or to the village as a whole, as the Village President deems reasonable and advisable, and applicable during such hours of the day or night, as the Village President deems necessary in the interest of the public safety and welfare;
(3) Approve previously appropriated expenditures of the city for the purpose of continuing the operations of the municipality;
(4) In the event the local state of emergency extends beyond the current fiscal year and a new budget has not been approved, approve new spending by the village during the existence of the local state of emergency;
(5) Order the discontinuance of the sale of alcoholic liquor by any wholesaler or retailer; or
(6) Order the discontinuance of selling, distributing or giving away gasoline or other liquid flammable or combustible products in any container other than a gasoline tank properly affixed to a motor vehicle.
(E) Duration. The declaration of a local state of emergency shall be effective for the earlier of a period of up to seven days or upon the adjournment of the first regular meeting of the corporate authorities after the state of emergency is declared, unless sooner terminated by a proclamation of the Village President, or, his or her interim emergency successor, indicating that the disaster no longer exists. A declaration may be continued or renewed beyond seven days by or with the consent of the Village Board of Trustees.
(F) Notice. Upon issuing the proclamation herein authorized, the Village Clerk shall notify the news media situated within the village, and shall cause at least four copies of the proclamation declaring the existence of the emergency and any curfew to be posted at the following places within the village: the village hall, the police station, the post office, and in the area of any curfew.
(G) Violations. Any person violating any fo the executive orders issued pursuant to this section shall be guilty of an offense against the village and shall be punished as provided by the village code.

The Board of Trustees may, on the recommendations of the Coordinator, authorize any purchases or contracts necessary to place the village in a position to effectively combat any disaster resulting from the explosion of any nuclear or other bomb or missile, and to protect the public health and safety, protect property and provide emergency assistance to victims in the case of such disaster, or from human-made or natural disaster.
