Nothing in this chapter shall be construed to:
(A) Interfere with the course or conduct of a private labor dispute; except that, action otherwise authorized by this chapter or other laws may be taken when necessary to forestall or mitigate imminent or existing danger to public health or safety;
(B) Interfere with the dissemination of news or comment of public affairs; but any communications facility or organization (including, but not limited to, radio and television stations and newspapers) may be requested to transmit or print public service messages furnishing information or instructions in connection with a disaster or emergency;
(C) Affect the jurisdiction or responsibilities of police forces, firefighting forces, units of the armed forces of the United States, or any personnel thereof, when on active duty; but the village emergency preparedness plan shall place reliance upon such forces available for performance of functions related to disaster emergencies; and
(D) Limit, modify or abridge the authority of the Village President or the Board of Trustees vested in them under the Constitution, statutes or common law of the state or village, independent of or in conjunction with any provisions of this chapter.

(A) There is hereby created an agency of the village to be known as the Village Emergency Management Agency (EMA) to prevent, minimize, repair and alleviate injury or damage resulting from disaster caused by enemy attack, sabotage or other hostile action, or from natural or a human-made disaster, in accordance with the State Emergency Management Act.
(B) The Village EMA created pursuant to this chapter supersedes any civil defense agency or emergency service and disaster agency heretofore created by the village, including the Village ESDA heretofore existing, the powers, functions, personnel and assets of which are hereby transferred to the Village EMA created hereby.
(C) The Village EMA shall consist of the Coordinator, Deputy Coordinator, Assistant Coordinators and other such technical, clerical and other administrative personnel as may be selected by the coordinator with the approval of the Village President or Village Administrator, and may make such expenditures within their appropriation therefore as may be necessary to carry out the purpose of this chapter.
(D) The Village EMA shall have jurisdiction over and serve the entire village, village property not located within the corporate limits of the village, and with the approval of the Village Board of Trustees, any other area which may decide to contract with the village for emergency management assistance.
(E) The Village Fire Department, by agreement with the village, shall perform the duties of the Village EMA and the Coordinator, Deputy Coordinators and Assistant Coordinators shall be comprised of active members of Village Fire Department.

(A) (1) The Fire Chief of the Village Fire Department shall serve as coordinator of the Village EMA. The Fire Chief shall serve as Coordinator until his or her successor is appointed and qualified.
(2) The Coordinator established pursuant to this chapter shall have a term of office commencing on 6-20-2010; until that time, the current Coordinator shall remain in office.
(B) The Coordinator shall have direct responsibility for the organization, administration, training and operation of the Village EMA as prescribed in the village’s emergency preparedness plan subject to the direction and control of the Village President. He or she shall coordinate the activities of all organizations for emergency management operations within the area served by the Village EMA and shall maintain liaison and cooperate with the emergency management agency of the county.
(C) In the event of the absence, resignation, death or inability to serve of the Coordinator, the Deputy Coordinator, or his or her designee, shall be and act as Coordinator until a new appointment is made as provided in this chapter.

(A) The two Deputy Fire Chiefs of the Village Fire Department shall serve as Deputy Coordinators of the Village EMA. The Deputy Fire Chiefs shall serve as Deputy Coordinators until his or her successor is appointed and qualified.
(B) The Deputy Coordinator shall act under the direction of the Coordinator in regards to daily and emergency functions.
(C) In the event of the absence of the Coordinator, the Deputy Coordinator shall be and act as Coordinator with direction of the Village EMA.
(D) In the event of the absence, resignation, death or inability to serve of the Deputy Coordinator, the Senior Assistant Coordinator, in regards to time served, shall be and act as Deputy Coordinator until a new appointment is made as provided in this chapter.

(A) The Assistant Coordinators of the Village EMA shall be selected and appointed from among the active officers/members of the Village Fire Department by the Village EMA Coordinator. The Assistant Coordinators shall serve at the pleasure of the Village EMA Coordinator. The Assistant Coordinators will be limited to three positions.
(B) The Assistant Coordinators shall act under the direction of the Coordinator in regards to daily and emergency functions.
(C) In the event of the absence of the Coordinator and the Deputy Coordinator, the highest ranking Assistant Coordinator, in regards to seniority of time served, shall be and act as Coordinator with direction of the Village EMA.
