8-2-4: STREET, PARKWAY AND SIDEWALK LITTERING, SNOW AND ICE MATERIALS:
   (A)   It shall be unlawful for any person, his agent, employee or servant, to cast, throw, drop, place, spill, sweep, sift or deposit in any manner whatsoever in or upon any street, alley, sidewalk, or parkway in the Village any of, but not limited to, the following materials, including paper, pasteboard, straw, excelsior, shavings, chips, sawdust, wood, rope, twine, wool, cotton, flax, hemp, jute, rubber, leather, ashes, cinders, soot, charcoal, coal, slag, dust, earth, sand, clay, gravel, lime, shells, mortar, plaster, tar, hay, grass, leaves, weeds, shrubbery cuttings, tree limbs or other landscape materials, grain, salt, hair, feathers, moss, shucks, bark, brick, stone, wire, nails, tacks, iron, tin, brass, copper, glass or pottery, or any kind of garbage, refuse or offal, whether animal or vegetable, or any slops, suds, swill, brine, rinsings, dishwater, urine; dirty, foul, bloody or ill-smelling liquid, or any excrement, manure, carrion, dead fish, fowl or animal, or any fruit or vegetable or any portion thereof, or any kind of dirt, rubbish, junk articles or things of substance whatsoever, whether liquid or solid, and whether of the same nature as the articles, things or substances herein specifically mentioned or not; any miscellaneous waste materials as defined in Section 7-2-1 of this Code and any materials as defined in Section 6-1-21 of this Code; provided that this Section shall not apply to the deposit of materials under a permit authorized by any provisions of this Code, nor to goods, wares or merchandise deposited upon any sidewalk, as otherwise provided in this Chapter, nor to the disposal of garbage, ashes, refuse, landscape products and other miscellaneous waste in accordance with the provisions of Title 7, Chapter 2 of this Code, or the disposal of hazardous waste and materials in accordance with the provisions of Title 5, Chapter 5 of this Code. This Section shall be applicable to the deposit of any of the stated materials upon any public street, alley, sidewalk, parkway or other public way or public grounds in this Village through the operation of a vehicle without properly securing its load, by binding or covering, so as to prevent spillage, leakage, scattering or deposit of such materials.
   (B)   In addition, it shall be unlawful for any person, his agent, employee or servant, including any independent contractor, to deposit any snow and ice from private premises, whether by snowplowing, snow shoveling or in any manner whatsoever, on or upon any street, alley, sidewalk, parkway, park or public place in the Village.
   (C)   Any person responsible for such unlawful placement, deposit or spillage of materials so designated herein shall be liable for the cost of removal thereof including, where the Village undertakes such removal services, labor costs, administrative costs, gasoline costs, disposal costs and such other costs as may be incurred in removing such materials in accordance with applicable laws or regulations.    (D)   In addition to liability for the costs of removal as provided herein, any person, his agent, employee or servant violating any provisions of this Section shall, upon conviction, be subject to the penalty as provided for by Section 1-4-1 of this Code, and each day that such violation continues shall be considered to be a separate offense. In lieu of filing a complaint in court, the proper police or public service officer may employ the citation procedure as provided in Section 9-2-15 of this Code in full settlement, compromise and disposition of any claimed violation of this Section, provided that said citation procedure shall, with respect to a first violation, be in the amount of twenty five dollars ($25.00) during the initial citation payment period and fifty dollars ($50.00) if the initial citation payment of twenty five dollars ($25.00) is not paid by the due date (10 days after citation is written), seventy five dollars ($75.00) during a second notice period, one hundred seventy five dollars ($175.00) during a final notice period, and two hundred fifty dollars ($250.00) during the final determination period.
