6-1-21: LITTERING:
It shall be unlawful to deposit, place, drop, spill, leave or otherwise abandon any food containers, candy or gum wrappers, paper handkerchiefs or napkins, plastic or styrofoam cups or plates, tin cans, paper or plastic bottles or containers, cigar or cigarette packages, yard clippings, brush or leaves, or any other materials as designated in section 8-2-4 of this code in or upon any public park, recreation area, or other public grounds or public building within this village, except where such materials are placed or deposited in a proper waste disposal receptacle. Any person violating this section shall, upon conviction, be subject to the penalty as provided for by section 1-4-1 of this code, and each day that such violation continues shall be considered to be a separate offense. In lieu of filing a complaint in court, the proper police or public service officer may employ the citation procedure as provided in section 9-2-15 of this code in full settlement, compromise and disposition of any claimed violation of this section, provided that said citation procedure shall, with respect to a first violation, be in the amount of twenty five dollars ($25.00) during the initial citation payment period and one hundred fifty dollars ($150.00) if the initial citation payment of one hundred dollars ($100.00) is not paid by the due date (10 days after citation is written), one hundred seventy five dollars ($175.00) during a second notice period, two hundred dollars ($200.00) during a final notice period, and two hundred fifty dollars ($250.00) in the final determination period. No person shall throw, spill or deposit upon any highway, any object, glass, nails, tacks, wire, or cans from a vehicle. Violation of this section will incur a two hundred fifty dollar ($250.00) original fine, three hundred dollars ($300.00) if the original fine of two hundred fifty dollars ($250.00) is not paid on the due date (10 days after citation is written), four hundred fifty dollars ($450.00) during a second notice period, six hundred dollars ($600.00) during a final notice period, and seven hundred fifty dollars ($750.00) in the final determination period.
