(A) Public health and safety. Additions or modifications to this chapter that directly effect public health and safety shall apply to any PD District whether prior to or during development.
(B) Deviation from this chapter. A PD District and its regulating ordinance shall not modify or supersede the applicability of §§ 165.001 through 165.018, 165.030 through 165.034, 165.045 through 165.051, 165.065 through 165.070, 165.120 through 165.127, 165.140 through 165.148, 165.160 through 165.165, 165.180 through 165.186, 165.200 through 165.205, 165.220 through 165.226, 165.240 through 165.246, 165.435 through 165.440, 165.455 through 165.470, 165.485 through 165.488, 165.500 through 165.514 and 165.999.
(C) Failure to comply. If a PD District is no longer proceeding in accordance with its regulating ordinance, commitments, conditions, covenants or time related requirements imposed by its regulating ordinance, the fullest extent of §§ 165.500 through 165.514 and 165.999 may be use by the Enforcement Official to cause remedy.
(D) Rezoning to standard district. All PD Districts, including phases or subdistricts, once 70% built-out are subject to being rezoned into an appropriate standard zoning district if the Plan Commission deems it necessary to better administer the development.
