§ 165.101 CENTRAL BUSINESS (CB) DISTRICT.
   (A)   CB District intent, permitted uses and special exception uses.
      (1)   District intent. The CB (Central Business) District is intended to be used as follows.
         (a)   Use type and intensity. Moderate intensity commercial and office uses.
         (b)   Application of CB District.
            1.   Existing and new development; and
            2.   Small to medium area zoning.
         (c)   Development standards.
            1.   Require quality time, place and manner development standards to minimize impacts on adjacent properties while encouraging economic vitality; and
            2.   Minimize light, noise, water and air pollution.
         (d)   Appropriate adjacent zoning districts. PR, UR, UV, IS, NC and CB.
         (e)   Plan Commission. Use the CB District for existing developments and carefully for new commercial development.
         (f)   Board of Zoning Appeals.
            1.   Allow a special exception use only when it is compatible with the surrounding areas; and
            2.   Be sensitive to aesthetics and the potential for light pollution, noise pollution, pedestrian safety and vehicular safety.
      (2)   Permitted uses.
         (a)   Accessory permitted uses. Small wind turbine system.
         (b)   Commercial permitted uses.
            1.   Bank machine/ATM;
            2.   Bar/tavern;
            3.   Barber/beauty shop;
            4.   Billiard/arcade room;
            5.   Broadcast studio;
            6.   Club or lodge;
            7.   Coffee shop;
            8.   Dance/night club;
            9.   Day care;
            10.   Delicatessen;
            11.   Farmer’s market;
            12.   Fitness center/health club;
            13.   Funeral home or mortuary;
            14.   Health spa/day spa;
            15.   Hotel/motel;
            16.   Ice cream shop;
            17.   Micro-brewery;
            18.   Micro-distillery;
            19.   Movie theater;
            20.   Office, design services;
            21.   Office, financial;
            22.   Office, general services;
            23.   Office, medical services;
            24.   Photography studio;
            25.   Restaurant
            26.   Retail (Type 1), very low intensity;
            27.   Retail (Type 2), low intensity;
            28.   Retail (Type 3), medium intensity;
            29.   Studio arts;

         (c)   Institutional permitted uses.
            1.   Bus station;
            2.   Parking lot, public;
            3.   Post office;
            4.   Rescue station;
            5.   School (P-12); and
            6.   Trade or business school.
         (d)   Residential permitted uses. Dwelling unit (upper floors).
      (3)   Special exception uses.
         (a)   Industrial special exception uses. Telecommunication facility.
         (b)   Residential special exception uses. Dwelling unit (first floor).

      (1)   Lots.
 
         (a)   Minimum lot area. One thousand square feet.
         (b)   Minimum lot width. N/A.

         (d)   Maximum density. Fifty units per acre.
         (e)   Maximum primary structures. Two per lot.
      (4)   Maximum structure height.

         (b)   Twenty feet for accessory structure.
