§ 1426.11 INSPECTIONS.
   (A)   Residential. Buildings and premises subject to this exterior property maintenance code are subject to inspection from time to time by the enforcing officer of the city. At the time of such an inspection, all exterior parts of premises shall be available and accessible for such inspection, and the owner, operator and occupant shall provide the necessary arrangements to facilitate such inspection. Such inspection shall be made between the hours of 8:00 a.m. and 4:00 p.m., unless the premises are not available during such hours or there is reason to believe that a violation exists of a character which is an immediate threat to health or safety, thereby requiring an inspection and abatement without delay.
   (B)   Nonresidential. Buildings and premises subject to this code are subject to inspection from time to time by the enforcing officer. At the time of such an inspection, all exterior parts of premises shall be available and accessible for such inspection, and the owner or operator shall provide the necessary arrangements to facilitate such inspection. Such inspection shall be made during the regular open hours of the business occupying such premises, unless there is reason to believe that a violation exists of a character which is an immediate threat to health or safety, thereby requiring an inspection and abatement without delay.
   (C)   Conduct of inspectors. Inspectors shall conduct themselves so as to avoid intentional embarrassment or inconvenience to occupants.
   (D)   Refusal of access.
      (1)   Where the Property Maintenance Officer or his or her agent is refused access or is otherwise impeded or prevented by the owner, occupant or operator from conducting an inspection of premises, such person shall be in violation of this exterior property maintenance code and subject to the penalty contained in § 1426.99.
      (2)   In addition to the provisions of this subsection, the Property Maintenance Officer may apply to the Municipal Court, upon affidavit, for a search warrant, setting forth factually the actual conditions and circumstances that provide a reasonable basis for believing that a nuisance or violation of this code exists on the premises. If the Court is satisfied as to the matter set forth in such affidavit, it may authorize the issuance of a search warrant permitting access to and inspection of that part of the premises on which the nuisance or violation exists. A warrant for access may be issued by the Court upon affidavit of the Property Maintenance Officer establishing the grounds therefor, pursuant to § 1426.22.
