§ 1426.99 PENALTY; EQUITABLE REMEDIES.
   (A)   Whoever violates or fails to comply with any of the provisions of this exterior property maintenance code, and who has not been previously convicted of a violation under this code, is guilty of a minor misdemeanor and shall be fined $100. Each subsequent conviction is a misdemeanor of the fourth degree. Each violation of a provision of this code shall constitute a separate and distinct offense independent of any other provision of this code or any order issued pursuant to this code. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues. Where the defendant is other than a natural person, this section shall also apply to any agent, superintendent, officer, member or partner who, alone or with others, has charge, care or control of the premises.
   (B)   The imposition of any penalty shall not preclude the Director of Law from instituting an appropriate action or proceeding in a court of competent jurisdiction to prevent an unlawful repair or maintenance; to restrain, correct or abate a violation; to prevent the occupancy of a building, structure or premises; or to require compliance with the provisions of this code or other applicable laws, ordinances, rules, regulations or orders or determinations of the Property Maintenance Officer or the Board of Zoning Appeals.
