§ 154.028 PRELIMINARY PLATS.
   (A)   Application for approval; generally.
      (1)   Upon the completion of the procedures in § 154.026, the subdivider shall prepare or cause to be prepared a preliminary plat, together with improvement plans and other supplementary material as specified in §§ 154.045 et seq. and in conformance with the standards of §§ 154.060 et seq.
      (2)   Six copies of the preliminary plat and supplementary material specified and a written application for approval of the preliminary plat shall be submitted to the City Manager not less than 15 days prior to the Planning Commission meeting at which it is to be considered.

   (B)   Review by City Manager; report and recommendations. The City Manager shall review the preliminary plat and supplementary materials submitted for the conformity thereof to this chapter and he or she shall provide the Planning Commission with a written report of his or her findings together with a recommendation that the preliminary plat be either approved conditionally approved or disapproved. A recommendation to conditionally approve shall contain the conditions, and a recommendation for disapproval shall contain the reasons therefor.

   (C)   Review by Planning Commission; recommendations of Planning Commission; report.
      (1)   (a)   The application for approval of a preliminary plat filed under §§ 154.025 et seq. shall be reviewed at a meeting of the Planning Commission and following its:
            1.   Review of the preliminary plat and other material submitted for conformity thereof to this chapter;
            2.   Consideration of the City Manager’s report and recommendations thereof; and
            3.   Negotiations with the subdivider on changes deemed advisable and the kind and extent of improvements to be made by him.
         (b)   The Planning Commission shall, within 35 days, act thereon as submitted or modified, unless an extension of time is applied for in writing by the subdivider and granted by the Planning Commission. If the preliminary plat is approved, the Planning Commission shall express its approval, if conditionally approved it shall express the conditions, or if disapproved it shall express its disapproval and the reasons therefor. Any approval, conditional approval, disapproval or other decision of the Planning Commission regarding a preliminary plat shall be advisory only and shall constitute a recommendation to the City Commission.
      (2)   When the preliminary plat has been passed upon by the Planning Commission, 4 copies of the preliminary plat shall forthwith be transmitted to the City Commission, together with a report showing the action of the Planning Commission.

   (D)   Consideration by City Commission; approval not to constitute approval of final plat.
      (1)   The application for approval of a preliminary plat filed under §§ 154.025 et seq. shall be considered at a meeting of the City Commission after its receipt of the report of the Planning Commission rendered pursuant to division (C) above.
      (2)   Any approval or conditional approval by the City Commission of a preliminary plat shall not constitute approval of the final plat. Rather it shall be deemed as an expression of approval of the layout submitted on the preliminary plat as a guide to the preparation of the final plat which will be submitted for approval to the Planning Commission and the City Commission for recording upon fulfillment of the requirements of this chapter and the conditions, if any, of a conditional approval of the preliminary plat.
