901.01   APPLICATION FOR PERMIT.
   (a)   No person, corporation or entity shall make any excavation, or cutting in or on any street, boulevard, avenue, alley, highway, roadway or other public ground, or remove the surface of any sidewalk or any part thereof, or open any sidewalk located in the Village of Perry, unless such person, corporation or entity has first filed with the Village an application for a permit, and have had the permit issued by the Village of Perry.
   (b)   The said application for a right of way permit shall be on a form provided by and approved by the Village of Perry, which application shall be accompanied by plans or specifications setting forth the location, kind and extent of the proposed excavation or removal of sidewalk, and the number, purpose and size of the excavations for which application is being made.
   (c)   Said application shall be accompanied by a nonrefundable fee in the amount of twenty-five dollars ($25.00), made payable to the Village of Perry. Any application filed pursuant to a contract with the Village of Perry, shall be exempt from the requirements of filing a fee.
   (d)   Said application shall also be accompanied by an additional deposit in an amount sufficient to cover the cost of inspection by the Engineer, the amount of said deposit to be determined by the Village Engineer. Said application shall also be accompanied by an additional deposit in the amount of the cost of backfilling, repairing, restoring and replacing all areas disturbed by the construction sought by the application. Said cost to be approved by the Village Engineer, said bond to be issued by a company licensed to do business in the State of Ohio by the Ohio Department of Insurance.

901.02   INSURANCE REQUIREMENTS.
   Said applicant shall also submit with the application an insurance policy, issued by an insurance company authorized to do business in the State of Ohio by the State Department of Insurance, designating the Village of Perry as named insured, and holding the Village harmless from any and all claims for bodily injury within the limits of five hundred thousand dollars ($500,000) for each person, and five hundred thousand dollars ($500,000) for each accident, and for property damage claims in the amount of two hundred thousand dollars ($200,000) for each accident arising or growing out of the street excavation, or removal of the surface of any sidewalk, or excavation of any sidewalk, or the prosecution of the work for which the permit is obtained, or in any manner arising or growing out of the work necessary, or incidental to the issuance of the permit, or that may be occasioned by reason of any excavation, or anything else done pursuant to the permit. 901.03   BARRICADES AND WARNING LIGHTS.
   Any and all excavation or construction made within the street lines or sidewalks shall be properly barricaded with warning signs, flashers and traffic control devices, as per the Ohio Department of Transportation Construction and Material Specifications and the Ohio Manual of Uniform Traffic Control Devices and shall be done in accordance with the direction of and under the supervision of the Village Engineer.
