OFFENSES
(A) It shall be unlawful to sell or offer for sale, at retail, or to give away, in or upon any licensed premises, any alcoholic liquor in the city between the hours of 12:00 midnight and 7:00 a.m. of any day; subject, however, to the following:
(1) That on Friday nights/Saturday mornings it shall be unlawful to sell or offer for sale, at retail, or to give away, in or upon any licensed premises, any alcoholic liquor in the city between the hours of 1:00 a.m. and 7:00 a.m.;
(2) That on Saturday nights/Sunday mornings it shall be unlawful to sell or offer for sale, at retail, or to give away, in or upon any licensed premises, any alcoholic liquor in the city between the hours of 1:00 a.m. and 12:00 noon;
(3) That whenever New Year’s Day falls on Monday, the premises may remain open, for business, on the preceding Sunday until 2:00 in the morning of New Year’s Day;
(4) That on New Year’s Eve and on New Year’s Day the premises may remain open, for business, until 2:00 in the morning of New Year’s Day;
(5) That on the fourth Wednesday of November in each year the premises may remain open, for business, until 1:00 a.m. of the fourth Thursday in November.
(B) It shall be unlawful to keep open for business or to permit the public to remain within, or to permit the consumption of alcoholic liquor in or upon any premises in which alcoholic liquor is sold at retail during the hours within which the sale of such liquor is prohibited; provided, that in the case of restaurants and hotels and grocery stores such establishments may be kept open for business during such hours, but no alcoholic liquor may be sold to, given away or consumed by the public during such hours; provided, further, that in the case of restaurants and hotels and grocery stores which are kept open for business during such hours all alcoholic liquor shall be kept securely locked and the key to the alcoholic liquor shall not be available to the public during such hours.
(C) It shall be unlawful for any person to purchase or to consume alcoholic liquor in or upon any premises in which alcoholic liquor is sold at retail during the hours within which such sale of alcoholic liquor is prohibited.

(A) It shall be unlawful for any person under the age of 21 years to purchase, obtain or attempt to purchase any alcoholic liquor in any tavern or other place in the city where alcoholic liquor is sold.
(B) It shall be unlawful for any person under the age of 21 years to misrepresent his or her age for the purpose of purchasing or obtaining alcoholic liquor in any tavern or other place in the city where alcoholic liquor is sold.
(C) It shall be unlawful to sell, give or deliver alcoholic liquor to any person under the age of 21 years.
(D) It shall be unlawful for any person under the age of 21 years to have alcoholic liquor in his or her possession, custody or control within the city.
(E) It shall be unlawful for any person under the age of 21 years to attend any bar, to sell, to draw, to pour or to mix any alcoholic liquor in any licensed retail premises.
(F) Except as otherwise provided herein, minors are prohibited from service or sales of alcoholic liquor. However, while servers who are aged 18 to 20 years of age may not pour or sell liquor, they shall be allowed to carry liquor from the pick up location and deliver it to the customer's table.
(G) It shall be unlawful for any person under the age of 21 years to serve, stock or arrange displays of alcoholic liquor in any licensed retail premises.
(H) No person or firm licensed under this chapter shall sell any such intoxicating liquor to any person under the influence of intoxicating liquor or to any idiot, insane or otherwise incompetent person. Nor shall any licensee permit any alcoholic liquor to be given in their place of business to any person under the influence of intoxicating liquor or to any idiot, insane or otherwise incompetent person.
(I) It shall be unlawful for any person to transport, carry, possess or have alcoholic liquor in any motor vehicle within the city except in the original package and with the seal unbroken.
(J) It shall be unlawful for any person to transport, carry, posses or have alcoholic liquor on any city street, alley or sidewalk within the city, except in the original package and with the seal unbroken.
(K) In addition to all other fines and penalties, the Mayor may suspend or revoke the retail liquor dealer’s license for the violation of any provision of divisions (A), (C), (E), (F), (G), (H) and (I).

(A) It shall be unlawful for anyone having a Class B license to sell or offer for sale any alcoholic liquor for consumption on the premises where sold, or to permit the same to be consumed on the premises where sold.
(B) It shall be unlawful for anyone having a Class A license to sell or offer for sale any alcoholic liquor other than beer for consumption on the premises where sold.
(C) It shall be unlawful for anyone having a Class D license to sell or offer for sale any alcoholic liquor other than beer for consumption on the premises where sold.
(D) It shall be unlawful for anyone having a Class E license to sell or offer for sale any alcoholic liquor other than beer or wine for consumption on the premises where sold.

All premises used for the retail sale of alcoholic liquor, or for the storage of liquor for sale, shall be kept in a clean and sanitary condition, and shall be kept in full compliance with the provisions regulating the condition of premises used for the storage or sale of food for human consumption.
