§ 115.35 CLOSING HOURS.
   (A)   It shall be unlawful to sell or offer for sale, at retail, or to give away, in or upon any licensed premises, any alcoholic liquor in the city between the hours of 12:00 midnight and 7:00 a.m. of any day; subject, however, to the following:
      (1)   That on Friday nights/Saturday mornings it shall be unlawful to sell or offer for sale, at retail, or to give away, in or upon any licensed premises, any alcoholic liquor in the city between the hours of 1:00 a.m. and 7:00 a.m.;
      (2)   That on Saturday nights/Sunday mornings it shall be unlawful to sell or offer for sale, at retail, or to give away, in or upon any licensed premises, any alcoholic liquor in the city between the hours of 1:00 a.m. and 12:00 noon;
      (3)   That whenever New Year’s Day falls on Monday, the premises may remain open, for business, on the preceding Sunday until 2:00 in the morning of New Year’s Day;
      (4)   That on New Year’s Eve and on New Year’s Day the premises may remain open, for business, until 2:00 in the morning of New Year’s Day;
      (5)   That on the fourth Wednesday of November in each year the premises may remain open, for business, until 1:00 a.m. of the fourth Thursday in November.
   (B)   It shall be unlawful to keep open for business or to permit the public to remain within, or to permit the consumption of alcoholic liquor in or upon any premises in which alcoholic liquor is sold at retail during the hours within which the sale of such liquor is prohibited; provided, that in the case of restaurants and hotels and grocery stores such establishments may be kept open for business during such hours, but no alcoholic liquor may be sold to, given away or consumed by the public during such hours; provided, further, that in the case of restaurants and hotels and grocery stores which are kept open for business during such hours all alcoholic liquor shall be kept securely locked and the key to the alcoholic liquor shall not be available to the public during such hours.
   (C)   It shall be unlawful for any person to purchase or to consume alcoholic liquor in or upon any premises in which alcoholic liquor is sold at retail during the hours within which such sale of alcoholic liquor is prohibited.
