5-5-1: DEFINITIONS:
GOLF CART: Has the same definition as set forth in section 1-123.9 of the Illinois vehicle code, namely, A vehicle specifically designed and intended for the purposes of transporting one or more persons and their golf clubs or maintenance equipment while engaged in the playing of golf, supervising the play of golf, or maintaining the condition of the grounds on a public or private golf course.
VILLAGE STREETS: Any streets or public alleys within the corporate limits of the village. (Ord. 16-04, 4-25-2016)
5-5-2: OPERATION OF GOLF CARTS ON VILLAGE STREETS:
A golf cart may be operated on village streets if:
   A.   The golf cart has the equipment set forth in section 5-5-3 of this chapter;
   B.   The operator meets permit requirements and has a current permit issued in accordance with section 5-5-4 of this chapter;
   C.   The operator displays on the vehicle a decal issued by the police department in accordance with section 5-5-4 of this chapter;
   D.   The operator complies with the provisions of section 5-5-5 of this chapter. (Ord. 16-04, 4-25-2016)
5-5-3: EQUIPMENT REQUIREMENTS:
No golf cart may be operated on a village street or be permitted for operation on a village street unless it has the following equipment:
   Brakes and brake lights.
   Headlight with white light visible from five hundred feet (500') to the front when vehicle is in operation.
   Horn.
   Rearview mirror.
   "Slow moving vehicle" emblem as defined in section 12-709 of the Illinois vehicle code.
   Steering wheel.
   Taillight with red light visible from one hundred feet (100') to the rear when vehicle is in operation.
   Tires.
   Turn signals, front and rear. (Ord. 16-04, 4-25-2016)
5-5-4: PERMITS:
   A.   The police department shall issue a permit for a golf cart upon application and an inspection of the golf cart. A permit shall be initially granted through December 31 of the year in which application is made, and annually renewed each year thereafter for the period January 1 through December 31. The cost of the permit is thirty dollars ($30.00).
   B.   Every application for a permit or renewal shall be made on a form supplied by the village and shall contain the following information:
      1.   Name and address of applicant;
      2.   Name of the applicant's liability insurance carrier;
      3.   The serial number, make, model and description of the golf cart;
      4.   Such other information as the village may require.
   C.   Each application shall be accompanied by:
      1.   A signed waiver of liability by applicant releasing the village and agreeing to indemnify and hold the village harmless from any and all future claims resulting from the operation of their golf cart on the village streets.
      2.   A photocopy of applicable liability insurance coverage card specifically for the vehicle to be operated pursuant to the permit and for the duration of the permit.
      3.   A nonrefundable thirty dollar ($30.00) inspection and permit fee.
   D.   Upon receipt of the application, police department will conduct an inspection of the vehicle to ensure that the vehicle is safe to operate on village streets and is otherwise in compliance with this chapter and with the state of Illinois motor vehicle code.
   E.   If the application is complete and the vehicle passes inspection, the police department shall issue the permit and give the applicant a decal to be displayed on the golf cart. (Ord. 16-04, 4-25-2016)
5-5-5: REGULATIONS AND RESTRICTIONS:
Persons operating golf carts on village streets are subject to all traffic laws, including laws relating to driving under the influence. In addition, the following regulations and restrictions shall apply.
Persons operating golf carts on village streets shall:
   A.   Have current liability insurance, and proof of liability insurance readily available for inspection by police officers.
   B.   Have a current permit for the golf cart, and display the village decal on the golf cart.
   C.   Have a current, valid Illinois driver's license or a valid out of state driver's license.
   D.   Observe the following additional rules of the road:
      1.   Golf carts shall be operated only between sunrise and sunset.
      2.   Golf carts shall not be operated on sidewalks or in the Village Square other than parking areas.
      3.   Golf carts may not be operated on streets and highways and roads under the jurisdiction of the Illinois department of transportation or the county highway department except to cross at designated streets.
      4.   Golf carts may not be operated on village streets when rain, snow, fog or other weather conditions hinder safe operations. (Ord. 16-04, 4-25-2016)
