2-1-2: CREATION OF COMMISSION:
There is hereby created an official planning and zoning commission to consist of a total of five (5) members to be appointed by the mayor and confirmed by the city council. The commission may consist entirely of appointive members or of both appointive members and ex officio members. (1959 Code §2-202; amd. 1990 Code)
2-1-3: QUALIFICATIONS; TERMS OF OFFICE; VACANCIES AND REMOVALS:
Appointive members of the commission shall be resident taxpayers; provided, that one such appointive member may be a nonresident taxpayer. The term of office for the ex officio members shall correspond to their respective tenure of office as an official or employee of the city. The term of office for the first appointive members of the commission shall be two (2), four (4) and six (6) years. Vacancies occurring otherwise than through the expiration of terms shall be filled by the mayor and confirmed by the council. Members may be removed after public hearing by a majority vote of the city council. Members shall be selected without respect to political affiliation and shall serve without compensation. 2-1-4: RULES, ORGANIZATION AND MEETINGS:
The commission shall elect its own chairman and create and fill such other offices as it may determine it requires for the proper conduct of the affairs and business of the commission. One regular meeting shall be held each month for not less than nine (9) months in each year. A majority of the appointive members of the commission shall be necessary to constitute a quorum at any meeting. All meetings shall be open to the public. Written rules consistent with this chapter and the laws of the state of Idaho for the transaction of business of the commission shall be adopted and a written record of meetings, resolutions, findings and determination shall be kept, which record shall be public. 2-1-5: POWERS AND DUTIES:
   A.   Generally: It shall be the duty of the planning and zoning commission to:
      1.   Recommend and make suggestions to the city council for the adoption of coordinated plans for the physical development of the municipality, for the forming of zoning districts.
      2.   Make suggestions concerning the laying out, widening, extending and location of streets, roads and highways for the relief of traffic.
      3.   Make suggestions concerning density of population and development of land.
      4.   Make suggestions concerning the future growth, development and beautification of the municipality in respect to its public buildings, streets, parks, grounds and lands in order to promote the public health, morals, safety and welfare of the inhabitants of the municipality.
      5.   Give suggestions and advice to individual citizens concerning landscaping and location of buildings, structures or works to be erected, constructed or altered by or for such individual. (1959 Code §4-601)
   B.   Acquisition And Disposition Of Property: The planning and zoning commission is authorized to acquire by gift, devise or bequest lands or other property to carry out the purposes of this chapter and shall likewise have power to sell or to otherwise dispose of property so acquired. (1959 Code §4-604)
2-1-6: MAPS, PLATS AND REPLATS:
Any and all maps, plats and replats of lands which require the approval of the city council or of any officer or employee shall first be submitted to the planning and zoning commission for its suggestions, and the commission shall have a reasonable time to be fixed by the council within which to examine such maps, plats or replats before returning the same with its suggestions. 2-1-7: EMPLOYEES AND EXPENDITURES:
Any expenditures of the planning and zoning commission, exclusive of gifts, shall be within the amounts appropriated and set aside by the city council for the purposes of the commission as set forth in this chapter. Within such limits, the commission is authorized to employ such employees and technical advisors as it deems necessary for the accomplishment of its authorized purposes and work. (1959 Code §4-603)
2-1-8: HEARING EXAMINER:
A hearing examiner may be appointed by the city council to act in the place of the planning and zoning commission. Pursuant to Idaho Code 67-6520, the hearing examiner shall have the same authority as the planning and zoning commission to hear requests for special use permits, variances, subdivision plats and annexations. The hearing examiner shall be planner, engineer, architect, or other professionally trained person and shall have significant experience in the field of planning and zoning but need not be a resident of the city. The hearing examiner may be dismissed by a majority vote of the city council. (Ord. 500, 4-9-2001)
