(a) No person shall manufacture fireworks in the City.
(b) No person shall possess fireworks in the City with the intent to sell them in the City, either at wholesale or retail.
(c) No person shall sell fireworks at wholesale or retail in the City.
(d) No person shall discharge, ignite or explode fireworks in the City pursuant to R.C. § 3743.45(D)(2).
(e) Any exhibitor licensed by the state to conduct public exhibitions shall be governed by Section 1305.04 and R.C. Chapter 3743.
(f) It shall be an affirmative defense to a charge brought under this section that the fireworks were used or intended for use:
(1) In emergency situations for marine, aviation or highway use;
(2) As signals in the safe operation of railroads;
(3) In connection with theaters or shows, as athletic signals or for ceremonial purposes, but only with regard to fireworks that are blank cartridges; or (Ord. 178-87. Passed 9-21-87.)
