1-3-2: DEFINITIONS, GENERAL:
Whenever the following words or terms are used in this code, they shall have the meanings herein ascribed to them, unless the context makes such meaning repugnant thereto:
ARS: Arizona Revised Statutes, as amended.
ACTS BY AGENTS: When this code or an ordinance requires an act to be done which may by law as well be done by an agent as by the principal, such requirement shall be construed to include all such acts when done by an authorized agent.
CODE: The code of the town of Parker, Arizona, unless the context indicates otherwise.
COUNCIL: The common council of the town.
COUNTY: The county of La Paz, Arizona.
DAY: The period of time between any midnight and the midnight following.
DAYTIME, NIGHTTIME: "Daytime" is the period of time between sunrise and sunset; "nighttime" is the period of time between sunset and sunrise.
DEPARTMENT, BOARD, COMMISSION, OFFICE, OFFICER OR EMPLOYEE: A department, board, commission, office, officer or employee of the town unless the context clearly indicates otherwise. Whenever reference is made in this code to a town department, board, commission, office, officer or employee by title only, this shall be construed as though followed by the words "of the town of Parker".
GENDER: A word importing either the masculine or feminine gender only shall extend and be applied to the other gender and to firms, partnerships and corporations as well.
IN THE TOWN OR WITHIN THE TOWN: Shall mean and include all territory over which the town now has, or shall hereafter acquire, jurisdiction for the exercise of its police powers or other regulatory powers.
JOINT AUTHORITY: All words purporting to give a joint authority to three (3) or more town officers or other persons shall be construed as giving such authority to a majority of such officers or other persons unless it shall be otherwise expressly declared in the law giving the authority.
LICENSE: The permission granted for the carrying on of a business, profession or occupation.
MAYOR: The mayor of the town.
MONTH: A calendar month.
OATH: Includes affirmation or declaration.
OCCUPANT: As applied to a building or land, shall include any person who occupies the whole or any part of such building or land, whether alone or with others.
OFFENSE: Any act forbidden by any provision of this code or the omission of any act required by the provisions of this code.
OPERATOR: The person who is in charge of any operation, business or profession.
OR, AND: "Or" may be read "and", or "and" may be read "or", if the sense requires it.
OWNER: As applied to a building or land, shall include any part owner, joint owner, tenant in common, joint tenant or lessee of the whole or of a part of such building or land.
PERSON: Shall extend and be applied to firms, corporations or voluntary associations, as well as to individuals, unless plainly inapplicable.
PERSONAL PROPERTY: Shall include every description of money, goods, chattels, effects, evidence of rights in action and all written instruments by which any pecuniary obligation, right or title to property is created, acknowledged, transferred, increased, defeated, discharged or diminished and every right or interest therein.
PRECEDING, FOLLOWING: Next before and next after, respectively.
PROPERTY: Shall include real and personal property.
REAL PROPERTY: Shall include lands, tenements and hereditaments.
RETAILER: Unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things direct to the consumer.
RIGHT OF WAY: The privilege of the immediate use of the roadway or other property.
SHALL HAVE BEEN: Includes past and future cases.
SHALL, MAY: "Shall" is mandatory; "may" is permissive.
SIGNATURE OR SUBSCRIPTION BY MARK: Includes a mark when the signer cannot write, such signer's or subscriber's name being written near the mark by a witness who writes his own name near the signer's or subscriber's name; but a signature or subscription by mark can be acknowledged or can serve as a signature or subscription to a sworn statement only when two (2) witnesses so sign their own names thereto.
STATE: The state of Arizona.
STATUTORY REFERENCES: References to statutes of the state of Arizona as they now are or as they may be amended.
STREET: Streets, avenues, boulevards, roads, alleys, lanes, viaducts, highways, courts, places, squares, curbs and all other public ways in the town which are dedicated and open to public use.
TENANT: As applied to a building or land, shall include any person who occupies the whole or any part of such building or land, whether alone or with others.
TIME, COMPUTATION: The time within which an act is to be done as provided in this code or in any order issued pursuant to any ordinance, when expressed in days, shall be computed by excluding the first day and including the last; except, that if the last day is a Saturday, Sunday or holiday, it shall be excluded; and when such time is expressed in hours, the whole of Saturday, Sunday or a holiday, from midnight to midnight, shall be excluded.
TIME, REASONABLE: In all cases where any section of this code shall require any act to be done in a reasonable time or reasonable notice to be given, such reasonable time or notice shall be deemed to mean such time only as may be necessary for the prompt performance of such duty or compliance with such notice.
TOWN: The town of Parker, county of La Paz, state of Arizona.
WEEK: Seven (7) consecutive days.
WHOLESALER, WHOLESALE DEALER: Unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things to persons who purchase for the purpose of resale.
WRITING: Includes any form of recorded message capable of comprehension by ordinary visual means. Whenever any notice, report, statement or record is required or authorized by this code, it shall be made in writing in the English language unless it is expressly provided otherwise.
