In this chapter, unless the context otherwise requires, the following words and terms shall have the meanings ascribed to them in this section:
CONTAINERS: Litter storage and collection receptacles as required and authorized in this chapter.
DEBRIS: Broken glass, broken concrete, broken plaster or gypsum board, scrap lumber, siding or roofing materials, ceiling tile or floor covering materials, broken asphalt materials, or broken concrete, clay, tile or plastic pipes or any similar scrap building or construction materials.
GARBAGE: Any spoiled or discarded animal or vegetable material resulting from the handling, preparation, cooking or consumption of food for humans or animals, as well as other organic waste materials subject to rapid decomposition.
JUNK: Scrap metal of all types; old appliances; motor vehicle parts; glass; paper; cardboard; old wood or lumber; furniture; furniture parts; stoves; sinks; cabinets; household fixtures; refrigerators; car parts; abandoned, broken or neglected equipment; mattresses; or any other material of no apparent economic value which is present in an obvious state of disarray.
LITTER: Any debris, garbage, junk, rubbish, trash or waste material, including solid wastes including, but not limited to ashes, street cleanings, rubbish, dead animals, solid market and industrial waste, paper, rags, empty barrels, crates, packing cases, packing materials, wrappings, cigarettes, cardboard, cans, yard clippings, leaves, metal, crockery, boxes, bottles, glass, cartons, refuse, plaster, plastics and other materials tending to create an unsightly condition and having an adverse effect upon the health, safety, economic, aesthetic or general welfare of adjoining properties or occupants.
LITTERING: Dumping, throwing, placing, depositing or leaving or causing to be dumped, thrown, deposited or left, litter, garbage, debris, trash, refuse, rubbish or junk of any kind on private or public property.
NUISANCE: Doing any act, or not performing a duty, or permitting any condition or thing to exist, which act, omission, condition or thing consists of one of the following:
A. Injures or endangers the health or safety of others.
B. Unlawfully interferes with, obstructs or tends to obstruct or render as dangerous with the free passage or use, in the customary manner, of any stream, public park, parkway, square, sidewalk, alley, street, avenue, boulevard, highway or right of way.
C. Obstructs the free use of property so as to substantially interfere with the comfortable enjoyment of life and property by a family, person, neighborhood or community.
PRIVATE PROPERTY: Any lot or lots, improved or unimproved, grounds, dwelling, house, building, or other structure which is not public property and shall include any yard, grounds, walkway, driveway, porch, steps or vestibules belonging or pertinent to such lot, grounds, dwelling, house, building or other structure.
PUBLIC PROPERTY: Any and all public streets, sidewalks, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds, lots and buildings.
REFUSE: Garbage or trash deposited in containers.
RESPONSIBLE PARTY: Any owner, tenant, renter, lessor, manager, or any fiduciary or person with power of attorney who is in charge of the premises or has authority and ability to act on behalf of or in the interest of the owner.
TRASH: Any solid waste consisting of both combustible and noncombustible waste, such as paper, wrappings, weeds, cigarettes, cardboard, tin cans, yard clippings, leaves, tree trimmings, metal, wood, glass, bedding, concrete, construction materials and similar materials of no economic value. The town manager may appoint one or more employees to enforce the provisions of this chapter. Citations may also be issued by the building, fire, and zoning inspectors. Furthermore, the town manager's designee may appoint other technical officers, inspectors and other employees that shall be authorized from time to time as necessary to carry out the functions of this chapter.
