§ 54.05 WINDBLOWN REFUSE PROHIBITED.
   It shall be unlawful to deposit or leave any refuse or material in such a place or condition that it can be blown by the wind so as to be scattered or cause clouds of dust or particles.

§ 54.06 HAULING; VEHICLE TO BE COVERED.
   It shall be unlawful to use any vehicle for hauling garbage or similar refuse in the city unless that portion of the vehicle containing the garbage or refuse is enclosed or completely covered with a tight tarpaulin.

§ 54.07 USE OF CITY REFUSE CONTAINERS RESTRICTED.
   It shall be unlawful to deposit or leave any refuse, garbage, or other material that has been accumulated at a home or business in a city refuse container. The use of all city refuse containers shall be limited to refuse accumulated by users of the city park system in the parks or by persons picking up trash and refuse that has accumulated on the streets, within the parks, or from other city property.

PRIVATE REFUSE COLLECTORS
§ 54.34 DEFINITIONS.
   For purposes of this subchapter, certain terms and words used herein shall be interpreted and defined as follows:
   GARBAGE. Refuse resulting from the handling, processing, preparation, cooking and consumption of food or food products.
   REFUSE. Any discarded matter, including but not limited to garbage, sweepings, landscape waste, paper, cardboard, tin cans, ashes, bottles, and similar other accumulations, but excluding special wastes as defined by Illinois Environmental Agency or other such agency.
   REFUSE COLLECTOR BUSINESS. A business that includes collection and disposal of garbage, ashes, manure, trash and miscellaneous waste and other refuse, as well as the renting, placing and removal of roll-off dumpsters.
   REFUSE COLLECTOR LICENSE. The license given to a person in the refuse collector business.
   ROLL-OFF DUMPSTER. A dumpster that is a rented bulk solid waste receptacle, placed temporarily in a driveway or other location, used to handle solid waste disposal related to temporary activities such as moving, remodeling or other construction at a site which is typically delivered and removed by truck. The rented container is hauled away when it is full and is emptied by mechanical means.

§ 54.35 LICENSE REQUIRED.
   (A)   No person, company, corporation or other enticy shall engage in the business of collecting, gathering or transporting in the city limits, any garbage, ashes, manure, miscellaneous waste or other refuse for compensation or otherwise, or operating a roll-off dumpster business without first having obtained a license to do so under penalty as provided for violation of this code.
   (B)   The city shall issue no more than three refuse collector licenses, which shall include all aspects of the refuse collector business.
   (C)   All licenses shall be issued upon application as set forth in the city code. Each license shall be good for one calendar year, commencing January and ending the following December. All licenses shall be issued on an application set forth in the code and subsequent approval by City Council.
   (D)   The license shall be subject to payment of annual fees as set forth in this code, and revocation for violations as set forth in this code.
