(a) A hazardous materials inventory statement (HMIS) shall be filed annually, by March 1 of each year, with the fire chief, in accordance with this chapter. Any person who stores or handles any hazardous material in an amount which is equal to or greater than the quantities specified in Section 17.20.020 is required to file an HMIS.
(b) Such person shall amend the HMIS within thirty days of the storage or handling of any hazardous material not listed thereon but required to be listed by Section 17.20.020(a) or of any increase of one hundred percent or more in the quantity of a previously disclosed material or an increase which brings the aggregate amount of a material above the quantity range listed in accordance with Section 17.20.020(c) or required to be identified in accordance with Section 17.20.020(d), or of a change in the business address, ownership, or business name.
(Ord. 4002 § 1 (part), 1990: Ord. 3716 § 2 (part), 1986: Ord. 3435 § 1 (part), 1983)
(a) Information shall be included in the HMIS for each hazardous material or mixture containing a hazardous material stored or handled in a facility (aggregated over all such materials stored in one or more storage facilities) where the aggregate quantity throughout the facility at any one time during the reporting year is equal to or greater than five hundred pounds in weight for solids, fifty-five gallons for liquids, or two hundred cubic feet at standard temperature and pressure (STP) for compressed gases. Additionally, an HMIS also shall be filed for any "acutely hazardous materials" stored on site above threshold reporting quantities pursuant to 40 CFR Part 355, Appendix A.
(b) The information in the HMIS shall include:
(1) For nonwastes: The general chemical name, common/trade name, major constituents for mixtures, the manufacturer, United Nations (UN) or North America (NA) number, if available, and the hazard class or classes and the material safety data sheet (MSDS) or equivalent information as required by city;
(2) For wastes: The three digit state waste number, using the number listed on the California Department of Health Services Uniform Hazardous Waste Manifest, DHS form 8022, the total estimated amounts of hazardous waste handled by the business throughout the year, the general chemical and mineral composition of the waste listed by probable maximum and minimum concentration, and the hazard class or classes;
(3) For both wastes and nonwastes, the following additional information shall be required: physical state, physical and health hazards, average daily amount, maximum capacity of largest container for each material, number of days on site, storage code (storage container type, pressure and temperature), and any additional Tier II inventory information required by Section 11022 of Title 42 of the United States Code, as that section may be amended from time to time;
(4) A listing of the chemical name and common names of every other hazardous material or mixture containing a hazardous material handled by the business which is not otherwise listed pursuant to paragraphs (1) or (2) of this subsection;
(5) The maximum amount of each hazardous waste, hazardous material or mixture containing a hazardous material disclosed in paragraphs (1), (2) or (3) of this subsection, which is handled at any one time by the business over the course of the year;
(6) Sufficient information on how and where the hazardous materials disclosed in paragraphs (1), (2) or (3) of this subsection are handled by the business to allow fire, safety, health and other appropriate personnel to prepare adequate emergency responses to potential releases of the hazardous materials;
(7) The standard industrial classification (SIC) code number of the business, if applicable, nature of the business, and the Dunn and Bradstreet number of the business;
(8) The name and twenty-four-hour phone numbers of the responsible person who is able to assist emergency personnel in the event of an emergency involving the business during nonbusiness hours.
(c) The HMIS may report the amount of hazardous material under this section by ranges, rather than a specific amount, pursuant to Section 17.16.020(c)(3), as long as those ranges provide the information necessary to meet the needs of emergency rescue personnel, to determine the potential hazard from a release of the materials, and meets the purposes of this title.
(Ord. 5381 § 10, 2016: Ord. 4002 § 1 (part), 1990: Ord. 3716 § 2 (part), 1986: Ord. 3435 § 1 (part), 1983)
For any hazardous material for which a claim has been made under Chapter 17.23, the exact name of the trade secret material, its quantity range by storage facility, and all other information required under Section 17.20.020(b) must, subject to the approval of city, be placed in a double-keyed lockbox and maintained in at least two locations at the facility. One key shall be provided to city at the time the permit becomes effective. The other key shall be maintained on site at all times, and readily accessible to permittee's designated emergency response person. Such emergency response person shall cooperate with city in opening the lockbox at any time city responds to an emergency or unauthorized discharge on the site involving the storage facility in which the trade secret material is contained. In the event that the permittee's designated emergency response person is not immediately available to assist city emergency response personnel to open the lockbox, such city personnel are authorized to break the lockbox.
