§ 12-6  BOATS.
   (A)   No boat shall be placed on Lake Devin unless the same has been approved and authorized by the city.  Every boat being operated on the lake shall be supplied with a life preserver for each occupant, two paddles and an anchor.
   (B)   Boats operated on Lake Devin shall be propelled only by means of electric motors or manually operated oars or paddles, unless the authorized agent of the city or the lessee, or a duly authorized agent of a lessee of the city shall specifically authorize the use of gasoline motor propulsion for emergency purposes. Boats with gasoline outboard motors may be allowed as long as the gasoline outboard is not operated while the boat is in the water.
   (C)   (1)   No more than four persons shall occupy a boat at the same time, and a boat shall not be rented to a person under 16 years of age.
      (2)   Persons under 16 years of age may be a passenger on a boat if accompanied by an adult.
      (3)   No private boat shall carry more than its boat capacity.
      (4)   The City Manager, or his or her designee, shall determine the capacity of a boat.
      (5)   All physically challenged persons, as hereinafter defined, are required to wear a life preserver or other flotation device at all times while occupying a boat.
   (D)   No boat shall enter or leave the lake, except from the area designated for boat launching.

   (E)   Punishment for a violation of this section shall be  as set forth in § 1-99, as amended.
