(A) (1) The fire official and any fire prevention inspector employed in his or her office are authorized as public officials to investigate violations of this chapter and, upon a determination that a violation has occurred, issue citations, stop work orders and monetary penalties.
(2) The fire official shall include written procedures, in rules he or she is authorized to promulgate pursuant to this chapter, for investigating violations, issuing citations, issuing stop work orders and collecting penalties.
(B) A violation of this chapter, which includes the technical codes and standards adopted herein by reference, shall subject the offender to the issuance of a citation, a stop work order, and the assessment of a penalty in an amount set forth in Ord. 95-8-2. These penalty amounts may be changed from time to time by the Board of City Commissioners. Penalties assessed shall be paid to the City Finance Department within 30 days after the offender has been cited for the violation. Each day the violation continues to exist shall constitute a separate offense for the purpose of assessing a penalty. The fire official may file a civil action to collect an outstanding penalty or the fire official may initiate the issuance of a criminal summons for the person's failure to pay the penalty.
