921.02 CROSS-CONNECTION, BACKFLOW PREVENTION AND WATER QUALITY PROTECTION.
   (a)    All new and existing water service connections, which in the opinion of the Village endangers or can endanger the public water supply from an existing or anticipated cross-connection shall install an approved backflow prevention device (BPD).
   (b)    The water user shall at his or her cost on written notice by the Municipal Director, or his designee, install a BPD approved by the Municipal Director, or his designee, of a type which meets the regulations of the Environmental Protection Agency, the Sanitary Code, and the American Water Works Association.
       (1)    If the water user fails to install an approved BPD within thirty days from receipt of written notice, or such date agreed by the parties, this Village shall:
         A.    Discontinue water service until the BPD is installed, or
         B.    Install the device and charge the cost thereof to the user water sewer bill.
   (c)   All BPD's shall be inspected annually on or before the anniversary date of the installation of the device and shall report the results in writing to the Village.
   (d)    Failure to perform the annual inspection and an inspection sheet in accordance with subsection (c) or within thirty days thereof, hereof shall result in a penalty of thirty-five dollars ($35.00) being added to the water sewer bill of the delinquent user for each month, or portion thereof, of noncompliance.
      (1)    If after one year and one month, noncompliance continues, the water user shall be notified by certified mail of the noncompliance. If compliance with written notice to the Village is not obtained within thirty days from the notice, water service shall be discontinued without further notice by the Village. Renewal of service shall be allowed only after written notice to the Village of a proper inspection and the assessment of a fifty dollar ($50.00) renewal of service fee, which shall be added to the user's water sewer bill.
   (e)    Inspectors must provide proof of proper licensing to the Village. Such licensing may be obtained from the Ohio Department of Commerce, the Operating Training Committee of Ohio or the equivalent approved by Municipal Director or his designee.
   (f)    The water user shall permit a qualified Village representative to investigate and survey backflow prevention and possible cross-connections as part of a control program for the Village and is required by the Environmental Protection Agency. Advanced notice by the Municipal Director, or his designee will be given prior to inspection. This inspection is separate from yearly maintenance inspection and is an investigative survey only and is at no additional cost to water user.
   (g)    Any charges incurred per 921.02(b)(1)(b), penalty set forth in 921.02 and the charge set forth in 921.02(d)(1) shall be deemed to be a "water charge" as set forth in 921.01(f) and shall become a lien upon the premises being served in the same manner as set forth in such section.
