921.01 WATER USAGE RATES.
   (a)   There is hereby established pursuant to the recommendation of the Utilities Advisory Board the following monthly rates to be charged for water usage in the Village of Ottawa:

Rates for industrial users located within the Village Corporation, with an average daily use of 25,000 cubic feet or more, may be negotiated.

   (b)   A penalty of ten percent (10%) of the outstanding balance shall be added to each bill for failure to pay for water charges by the due date. Payments must be postmarked or received by the due date. The water charges levied shall be billed monthly.
   (c)   Water service shall be terminated for accounts which remain unpaid for a period of forty-five (45) days past the due date. Such service will be resumed upon payment of all delinquent charges and a $50.00 disconnect/reconnect fee.
   (d)   The owner(s) of all lots, lands and premises hereinafter developed located within the Village of Ottawa and that are hereafter annexed by the Village of Ottawa, shall connect with the Village of Ottawa water distribution system upon such water distribution system being made reasonably available to such owners.
   (e)   There is hereby established a rate for residents of the Village who have Village water available, but are not connected to the system. Said rate is established based on the perceived benefits derived from the Village water system. Said rate shall be three dollars and fifty cents ($3.50) per month to be billed monthly along with other water bills.
   (f)   The funds received from the collection of the rates and charges hereinafter provided shall be deposited as received with the Clerk-Treasurer, who shall keep the same in a separate fund designated “Water Fund”. Subject to the provisions of any ordinance or indenture of mortgage authorizing the issuance of and securing mortgage revenue bonds for said System, monies in said Fund shall be used for operation, maintenance, repair an management of the System, fund for payment of debt charges on bonds issued for extensions and improvements of the System, and any surplus in said Fund over and above the requirements hereinbefore mentioned may be used for enlargements of and replacements to the System and parts thereof.
   (g)   Each water charge levied pursuant to this section is hereby made a lien upon the premises charged therewith, and if the same is not paid, it shall be certified to the Auditor of Putnam County, who shall place the same on the tax duplicate, with the interest and penalties allowed by law, and be collected as other Municipal taxes are collected.
   (h)   The Utilities Board shall make and enforce such rules and regulations as it may deem necessary for the enforcement of the provisions hereof, for the proper determination and collection of the rates and charges herein provided, and for the safe, efficient and economical management of the Water Treatment System; and such rules and regulations, when not repugnant to existing ordinances of the Village or laws of the State of Ohio, shall have the same force and effect as ordinances of Council.
   (i)   No lot, parcel of land, building or premises now or hereafter used by the Village for municipal purposes shall be subject to water charges hereby established.
   (j)   Nothing in this section shall be construed as prohibiting the Village from entering into contracts for providing water services outside the Village corporate limits at different rates other than contained in subsection (a) hereof and upon such terms and conditions as it deems necessary.
   (k)   (1)   No person shall purchase bulk water in the Village of Ottawa without first making an application therefore at the Clerk’s Office. Bulk water is water that is purchased from the device located east of the Village of Ottawa Municipal Garage. Upon review of the application, the Utilities Director or Municipal Director or their designee retains the right to deny the privilege of selling bulk water to any person at any time.
      (2)   A service fee of four dollars and fifty cents ($4.50) will be assessed with every purchase of bulk water. The general rate shall be as follows:
Beginning January 1, 2016
         1,000 gallons water or portion thereof - $12.53
         100 cubic feet water or portion thereof - $9.37
Beginning January 1, 2017
         1,000 gallons water or potion thereof - $13.40
         100 cubic feet water or portion thereof - $10.02
         For purposes of the service fee, any agreement to purchase bulk water for a period of time not exceeding seven days shall be considered a purchase of bulk water.
      (3)   The applicant/user must give the Village notice of at least twenty-four hours before purchasing unless the Utilities Director or Municipal Director agrees to notice of less than twenty-four hours because of an unusual circumstance.
      (4)   The applicant/user may only purchase bulk water weekdays during staffed hours unless special arrangements are made in which case the applicant/user will be responsible for paying the time costs for the Village employees required to accommodate applicant/user’s special arrangements.
      (5)   The Village does not assume any liability for the quality of bulk water after delivery to applicant/user.
      (6)   The applicant/user will be liable to the Village for any extra costs, fines or penalties incurred by the Village as a result of any deviations of this subsection. Violation of this subsection would result in permanent suspension of purchasing privileges. The Utilities Director or Municipal Director shall enforce the provisions of this subsection.
