The Director of Public Service shall be appointed by the Mayor subject to confirmation by a majority of the members of Council, to serve at the pleasure of Council. He/she shall be an engineer or have comparable qualifications. The Director of Public Service shall have charge of all public works, water supply and distribution systems, sewage disposal and sewer systems, improvements, construction and operation thereof, and of all engineering, maintenance, and inspection in connection therewith, and shall perform all duties imposed by the Mayor or Council.
If the Director of Public Service position becomes vacant, the Deputy Engineer shall temporarily act as the Director of Public Service until the position is filled.
The Council shall have the sole authority to establish and prescribe water, sewer rental or other rates and charges.
Any rules, regulations or bylaws adopted, promulgated or established by the Director of Public Service shall be approved by a majority of the members elected to Council before the same become effective.
All contracts relating to the matters referred to in this section shall be authorized by Council and executed by the Mayor and the Finance Director.
The provisions of this section are not intended, nor shall they be construed so as, to confer upon such Director of Public Service any right, power or authority granted to, conferred upon, possessed or exercisable by the Council under the provisions of this Charter, or the Constitution and laws of Ohio, or to in any manner limit, restrict, or abridge any such right, power or authority or the full and complete exercise thereof, all of which rights, powers and authorities are expressly reserved to and hereby vested in the Council.
