The purpose of this ordinance is to establish subdivision standards and procedures which will promote the public health, safety, convenience, comfort, prosperity, and general welfare of the residents of and visitors to the City of Oberlin, Ohio through pursuit of the following objectives:
(a) Orderly development of land to obtain harmonious and stable residential, commercial and industrial areas:
(b) Safe and convenient vehicular and pedestrian circulation;
(c) Reservation of space for recreation, open space and other public use;
(d) Accurate surveying of land; preparation and recording of plats;
(e) Assurance that subdivision improvements are properly installed and completed in compliance with the specifications and standards established by the City, and correctly and completely recorded; and
(f) Coordination of land development in accordance with the Zoning Ordinance and the Comprehensive Plan.

The Planning Commission derives its authority to regulate subdivisions by virtue of the statutes contained in Ohio Revised Code Chapter 711 and Section XIX E of the Oberlin City Charter.

The provisions of this Subdivision Ordinance shall be held to be minimum requirements. Whenever these provisions differ from the requirements of other lawfully adopted regulations, covenants, rules, laws or restrictions, the more restrictive rule or higher standard shall govern.

No land shall be subdivided except in compliance with this Subdivision Ordinance and with the provisions of the Zoning Ordinance of the City of Oberlin.
No land shall be subdivided within the City of Oberlin until:
(a) The subdivider has submitted plats and other documentation and information as described by this Subdivision Ordinance,
(b) Said plats have been approved as provided herein, and
(c) The approved plats have been recorded in the Office of the Lorain County Recorder.
No building permit, zoning permit, or certificate of occupancy shall be issued for any parcel of land which was created by subdivision after the effective date of, and not in conformity with, the provisions of this ordinance, and no construction of public improvements shall take place or be commenced except in conformity with this Subdivision Ordinance and other applicable codes.
No plat of any subdivision shall be recorded by the Lorain County Recorder or have any validity until it has been approved in the manner prescribed herein. In the event any such unapproved plat is recorded, it shall be considered invalid and the Planning Commission shall institute proceedings to have the plat stricken from the County records.
No owner or agent of the owner of any land located within a subdivision shall transfer or agree to transfer ownership in the future by reference to, exhibition of, or by use of a plan or plat of a subdivision before such plan or plat has been approved and recorded in the manner prescribed herein. Any sale or transfer contrary to the provisions of this section shall invalidate such plan or plat. The description of a lot or by metes and bounds in an instrument of transfer or other document used in the process of selling or transferring shall not exempt the transaction from the provisions of this Subdivision Ordinance.
