A. General: Whenever a permit is issued by the Village for "development", as defined in Section 6-14A-2 of the Village Code, including any reconstruction, rehabilitation, or repair of an existing structure damaged in an amount that reduces the property value by fifty percent (50%) or more, or any construction, reconstruction or addition to an existing structure that increases the property value by fifty percent (50%) or more, sidewalks shall be constructed as part of said development by the developer, installer/contractor or property owner along all streets adjacent to said property, except as otherwise provided in this Article. If a street is planned for widening within five (5) years of the date of final development approval, the developer, installer/contractor or property owner shall, in lieu of constructing said sidewalk, place funds for sidewalk construction in escrow with the Village in the amount of one hundred twenty five percent (125%) of the estimated cost, as approved by the Director of Quality Control.
B. Public Streets:
1. All collector and major or minor streets in residential districts with average lot sizes of twenty thousand (20,000) square feet and under, or in commercial and industrial districts located within walking distance of pedestrian destinations or with frontages averaging less than two hundred feet (200'): a minimum five foot (5') wide sidewalk with a five foot (5') wide planting/green strip, is required on both sides of the street and around cul-de-sacs. Wider sidewalks may be required in some commercial areas.
2. Streets in residential districts with average lot sizes exceeding twenty thousand (20,000) square feet, or averaging a minimum of one hundred fifty feet (150') of frontage: no sidewalks are required, except for sidewalks along streets which serve as the primary collector streets serving at least thirty (30) homes.
3. Any street within two (2) blocks of a school site, park or public building that is determined by the Director of Quality Control to be a walking route to those destinations: sidewalks are required on both sides of the street.
4. New streets: sidewalks may be omitted on only one side if that side cannot be developed and there are no existing or anticipated uses that would generate pedestrian trips on that side.
5. Rights of way which are below standard widths: sidewalk installation is subject to Village Engineer review.
C. Private Streets: The same sidewalk standards are required for private streets as for public streets, unless other design guidelines are applied for as part of a planned unit development.
D. Location: The location of sidewalks shall generally be one foot (1') inside of the right-of-way boundary line. The location may be modified, depending on factors that include, but are not limited to: relationship to drainage ditches, easements, public utility rights of way and towers, handicapped ramps, existing trees, landscaping, and topography. (Ord. 94-10-44)
A. Driveways Across Sidewalks and Parkways: No person, firm or corporation shall construct or alter any driveway over, across or upon any public sidewalk or parkway strip without first obtaining a permit from the Department of Quality Control. Where ingress and egress is to be made from adjoining real estate to a public street and where the Code requires off-street parking, such off-street parking shall be made accessible to the public street and the ingress and egress shall be made across the parkway strip and sidewalks by means of a driveway constructed in accordance with this Article.
B. Permit Application: Application for a permit to construct a driveway shall be on forms provided by the Department of Quality Control. The application shall designate the location of the proposed driveway, the name and address of the applicant, the name and address of the owner of the property to be served by the proposed driveway, and the address of the applicant, if other than the owner, and a plat of survey indicating the driveway location and dimensions proposed. In those instances where a driveway is required to comply with the requirements of the off-street parking and loading sections (Section 4-13-1 et seq.) of this Code, the permit application shall accompany the application for the issuance of a building permit authorizing the new building construction.
C. Permit Issuance and Fees: The Department of Quality Control shall issue a permit to construct a driveway provided that the permit application is complete, is in accordance with these regulations and the applicable permit fee has been paid.
D. Permit Revocation: All permits for driveways issued pursuant to this Article may be revoked at any time without the consent of the permittee by order of the Director of the Department of Quality Control. A permit may be revoked for failure of a permittee to comply with any of the provisions of this Article or failure to comply with any permit-related provision of the Code. A notice of noncompliance, setting forth the Code provision(s) violated, shall be mailed by the Director via certified mail, or hand delivered, to the permittee and the permittee shall have five (5) business days from the date of receipt of said notice to cure any such Code violation. If the permittee fails to cure said Code violation in the time period provided or if remedial action by the permittee is insufficient to remove said Code violation, and the Director revokes said permit, the permittee may appeal the revocation decision to the Appeals and Review Board in accordance with the provisions set forth in Section 2-2-2 of this Code. Upon such revocation, all rights granted under the permit shall be revoked, and if no appeal is taken, the sidewalk, parkway strips and/or curbs shall be immediately restored to their former condition, at the expense of the permittee and/or of the owner of the property served by the driveway at the time of such revocation. If an appeal is taken, it shall be the permittee's responsibility to barricade the construction site in accordance with Section 9-1A-6 of this Code for the duration of the appeal.
E. Maximum Number: Single-family residences shall be permitted to have only one driveway, unless an increase in the number of allowable driveways is approved by the Board of Trustees upon recommendation of the Appeals and Review Board. All other uses shall be allowed as approved by the Board of Trustees upon recommendation of the Zoning and Planning Commission.
F. Minimum Length And Width: The minimum driveway length shall be from the street access to a point forty feet (40') behind the minimum setback line, and the minimum width of said driveway shall be nine feet (9') at the sidewalk line and fifteen feet (15') at the curb. When the only parking space(s) located on a driveway is/are in the front yard, the minimum driveway length, as provided by this subsection, shall not be applicable to the driveway.
G. Maximum Width: The maximum width for driveways for single- family residences shall be twenty feet (20') at the sidewalk line (or property line if no sidewalk exists) and twenty six feet (26') at the curb line; provided, however, that if the driveway is in conjunction with a three (3) car garage, the maximum driveway width may be increased to thirty feet (30') at the sidewalk line (or property line if no sidewalk exists) and thirty six feet (36') at the curb line. No driveway shall encroach upon any portion of the parkway strip adjacent to the adjoining properties. The maximum width for driveways for all other uses shall be twenty five feet (25') at the sidewalk line and shall be constructed with ten foot (10') radius returns unless otherwise required or determined by the Director of Quality Control.
H. Grades And Curbs: Driveways shall conform to the existing sidewalk grade. Where it is necessary to break the existing curb for the driveway opening, the curb and gutter shall be completely removed and a new section constructed. Each such driveway shall be constructed and maintained so as to permit free and unobstructed passage on, over or across the sidewalk and in such a manner as not to interfere with the proper drainage of streets. The slope of any driveway and the approaches thereto shall not exceed one inch (1") per foot in any direction. Each such driveway shall be so constructed and maintained that its surface at the point of crossing any sidewalk pavement shall be flush with the adjoining sections of such sidewalk.
I. Lots Abutting Both A Minor Street And A Collector Or Major Street: In subdivisions where lots abut both a minor or marginal access street and a collector or major street, no driveways shall be installed so as to exit onto the collector or major street.
J. New Driveway Aprons Abutting Existing Sidewalks Or Curbs: New driveway aprons abutting existing sidewalks or curbs shall be constructed to meet the grade of such sidewalks or curbs. If necessary, the sidewalk shall be relocated to accommodate the maximum driveway apron slope. The location and grade for driveway aprons, when no adjacent sidewalks or curb and gutter exists, shall match the adjacent parkway. The maximum slope of the driveway apron shall be eight and thirty three hundredths percent (8.33%), and the minimum slope shall be two percent (2%).

G. Placing and Finishing Concrete:
1. The Department of Quality Control shall be notified when the subgrade has been finished and is ready for inspection. A minimum of three (3) hours notice shall be given prior to placing concrete. No concrete shall be placed until the subgrade has been inspected and approved by the Department of Quality Control.
2. Materials should not be placed on ice or frozen subgrade.
3. The subgrade shall be moistened just before the concrete is placed. The concrete shall be placed in successive batches for the entire width of the slab, struck off from one-half inch (1/2") to three-fourths inch (3/4") higher than the finished slab, tamped until all voids are removed and free mortar appears on the surface, thoroughly spaded along the edges, struck off to the true grade, and to eliminate high and low spots and to embed large aggregate particles, a bull float or darby should be used immediately after strikeoff but before bleedwater accumulates on the surface. No finishing operation shall be performed on the surface of a concrete slab while bleedwater is present. After the bleedwater evaporates, the concrete shall be finished to a true and even surface with floats. Lastly, the surface shall be given final finish by brushing with a broom. The broom shall be drawn across the sidewalk, driveway or driveway apron at right-angles to the edges of the slab, with adjacent strokes slightly overlapping, producing a uniform, slightly roughened surface with parallel marks.
H. Control Joints:
1. Sidewalks: Control joints shall be constructed at right angles to the center line of the sidewalk and shall extend one-fourth (1/4) the depth of the sidewalk. They shall not be less than one-eighth inch (1/8") nor more than one-fourth inch (1/4") in width, and shall be edged with an edging tool having a one-fourth inch (1/4") radius. The control joints shall be not less than one-eighth inch (1/8") nor more than one-fourth inch (1/4") in width, and shall be edged with an edging tool having a one-fourth inch (1/4") radius. The minimum depth shall be one and one-fourth inches (11/4").
I. Protection from Low Temperatures: If concrete is placed after the first seasonal frost, concrete shall be protected from freezing in accordance with the "Recommended Practice for Cold-Weather Concreting" (ACI 306). Air-entrained concrete shall not be allowed to freeze and thaw in a saturated condition prior to developing the required design compressive strength (ACI 308). The developer or installer/contractor shall be responsible for all concrete damaged by low temperatures, and any damaged concrete shall be removed and replaced by the developer or installer/contractor at the developer or installer/contractor's expense.
J. Curing:
1. After finishing the concrete, in accordance with subsection G above, all sidewalks, driveways and driveway aprons shall be cured, in addition to the curing requirements set forth in subsection J2 below, by one of the following methods:
a. Burlap shall be placed on the finished surface, saturated with water and covered with an impermeable covering.
b. Polyethylene sheeting shall be placed as soon as the concrete has sufficiently hardened to prevent marring of the surface. The surface of the concrete shall be wet immediately before the sheeting is placed. The edges of the sheeting shall be weighted securely with a continuous windrow of earth or any other means satisfactory to the Department of Quality Control to provide an airtight cover.
c. Liquid-membrane-forming/curing compound shall be applied per ASTM C309 immediately after broom finish.
2. A minimum thirty (30) day drying period after seven (7) days of moist curing, if concrete is placed in the fall and will be exposed to freeze-thaw cycles and deicers when saturated, is required. When temperatures fall to near forty degrees (40°) Fahrenheit, a fourteen (14) day curing period may be necessary when using Type I, normal cement. The required curing period can be reduced to seven (7) days by using a Type III high-early-strength cement or a higher cement content in the concrete.
Any of the three (3) curing methods set forth in subsection J1 above must remain in place for not less than six (6) days.
K. Backfill: After the concrete has been cured, forms shall be removed and the space near the edges of the sidewalk, driveway or driveway apron shall be backfilled to the required elevation with material approved by the Department of Quality Control. The material shall then be compacted until firm and the surface evenly graded.
L. Disposal of Surplus Material: Surplus or waste material resulting from the sidewalk, driveway or driveway apron construction shall be disposed of by the developer, installer/contractor or property owner.
M. Control of Materials: The developer or installer/contractor shall, when requested by the Village and at the developer or installer/contractor's expense, have a commercial testing laboratory prepare and test samples of delivered concrete. One set of tests shall be taken for the first twenty five (25) cubic yards, or fraction thereof, and one set of tests shall be taken for each additional fifty (50) cubic yards. A set of tests shall consist of four (4) standard cylinders (2 shall be broken at 7 days and 2 shall be broken at 28 days), one slump test and one air content test. The laboratory shall perform tests in accordance with recognized ASTM standards and shall submit written reports of such tests to the Village Engineer for review.
