No owner, proprietor, manager or person in charge of any business establishment open to and patronized by the public within the Municipality shall permit any musical instrument or mechanical music device to play, be played or be heard, or permit any singing to be done or heard, within such establishment, between the hours of 2:30 a.m. and 7:00 a.m. Monday through Saturday or between 2:30 a.m. and 1:00 p.m. on Sunday.

Any owner, proprietor, manager or person in charge of any business establishment affected by this chapter may, to meet special events and occasions, make application to the Director of Finance for a permit to continue music or entertainment beyond the hours stipulated in Section 842.01 as an exception to the prohibitions of this chapter. The Director may grant such permit if, in the judgment of the Mayor, it is reasonable, proper and not detrimental to the public interest and welfare. Such permit, in any case, shall be valid only within the time specified thereon and the Mayor's judgment and action in the granting or denial thereof shall be final. Such permit may be cancelled at any moment by the Mayor if, in his or her judgment, it should be so cancelled.

Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor for a first offense; for a second offense, such person is guilty of a misdemeanor of the third degree; for a third or subsequent offense, such person shall be guilty of a misdemeanor of the second degree. Whoever is convicted of or pleads guilty to a misdemeanor, or minor misdemeanor shall be sentenced in accordance with Section 698.02. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
