(a) Whoever violates section 864.01(a) is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for the first day of the violation. For each day thereafter, that a violation continues, such person is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both.
(b) Whoever violates Section 864.01(b) is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250® 00) or imprisoned not more than thirty days, or both, for the first day of the violation. For each day thereafter, that a violation continues, such person is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500. 00) or imprisoned not more than sixty days, or both.
