844.02 LICENSE REQUIRED; ISSUANCE.
   (a)   Conditions; Conformity to Zoning Code. No person shall operate and maintain a junk yard within 1, 000 feet of the nearest edge of any duly dedicated public thoroughfare used for vehicular traffic within the Municipality, except in those areas zoned for such use pursuant to the Zoning Code, without first obtaining a license therefor from the Mayor. Any person operating or maintaining a junk yard within 1, 000 feet of the nearest edge of any such duly dedicated public thoroughfare, except in those areas so zoned, prior to the effective date of this section (Ordinance 73-21, passed February 20, 1973), shall, on or before January 1, 1974, erect the required fence yr make suitable plantings, if such junk yard is not already screened by natural objects or by a fence. This exception does not affect the regulation or prohibition of junk yards in areas zoned for such pursuant to the Zoning Code (Ordinance 71-68, passed October 18, 1971, as amended). If a junk yard is established after the effective date of this section (Ordinance 73-21, passed February 20, 1973), anal is located within 1, 000 feet of the nearest edge of any duly dedicated public thoroughfare used for vehicular traffic within the Municipality, it shall be so located that the view thereof from such thoroughfare is obscured by natural objects or a fence. If the yard is so obscured, the person operating or maintaining it shall be issued a license under this section. Nothing in this section shall be construed to relieve any person of his duty to comply with the applicable provisions of the Zoning Code (Ordinance 71-68, passed October 18, 197-1 , as amended). A requirement to obtain. a license from the Municipality under this section shall be in addition to regulations imposed and required under such Zoning Code. No license shall be issued unless such yard complies with the provisions of this chapter.
   (b)   Fees; Renewal. The fee for a license issued under this section shall be seventyfive dollars ($75.00). All such licenses shall expire on January 1 following the date of issue. A license may be renewed froze year to year upon paying to the Mayor the sum of seventy-five dollars ($75.00) for each such renewal.
   (c)   Revocation. Any license or renewal thereof issued under this section may be revoked by the Mayor, after reasonable notice and opportunity to be heard., for a violation of any of the provisions of this chapter by the licensee or by any of his officers, agents or employees. Whenever a license has been revoked under this section, the Mayor shall not issue another license to such licensee, to the husband or wife of such licensee or to any partnership or corporation of which he is an officer or member, until such licensee complies with the provisions of this chapter.

   (d)   Exception. Junk yards located within M-2 General Manufacturing Districts which are zoned for the operation and maintenance of such junk yards, even though they are situated within 1, 000 feet of the nearest edge of any duly dedicated public thoroughfare for vehicular traffic within the Municipality, are exempt from the operation and effect of this section.
