(b) Whoever violates Section 351.04(f)(1)A. or B. is guilty of a misdemeanor and shall be fined not less than two hundred fifty dollars ($250.00) nor more than five hundred dollars ($500.00), but in no case shall the offender be sentenced to any term of imprisonment. A violation of Section 351.04(f)(1)A. or B. does not constitute a criminal record and need not be reported by the person so arrested or convicted in response to any inquiries contained in any application for employment, license, or other right or privilege, or made in connection with a person’s appearance as a witness.
Every fine collected under this subsection (b) shall be paid by the Clerk of the Court to the Municipality, except as provided in this subsection, the Municipality shall use the moneys it receives under this subsection to pay the expenses it incurs in complying with the signage and notice requirements contained in Section 351.04(e). The Municipality may use up to fifty percent (50%) of each fine it receives under this division to pay the costs of educational, advocacy, support and assistive technology programs for persons with disabilities, and for public improvements within the Municipality that benefit or assist persons with disabilities, if governmental agencies or nonprofit organizations offer the programs.
(1) Except as otherwise provided in subsection (2) below, the offender shall be issued a warning.
(2) If the offender previously has been convicted of or pleaded guilty to a violation of Ohio R.C. 4511.69(h) or Section 351.04(h) of this Traffic Code, the offender shall not be issued a warning but shall be deemed guilty of a misdemeanor and shall be fined not more than twenty-five dollars ($25.00) for each parking location that is not properly marked or whose markings are not properly maintained.
(c) Offenders who are summoned pursuant to Section 353.03(b) shall pay a fine of not less than the minimal fine schedule found in Section 353.07(a) nor more than the maximum fine allowed for minor misdemeanors, except that handicap parking violations under Section 351.04(f)(1)A. or B. may be fined up to the maximum fine so provided for in Section 353.99(b).
(d) Whoever violates Section 351.12 is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, such person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the second offense, such person is guilty of a misdemeanor of the third degree. A violator of Section 351.12 shall be cited on a uniform traffic citation and personally served. The violator shall be notified of the date, time and place to appear in court. The violator may post bond on a first offense in accordance with the bond schedule, if any, of the court with jurisdiction.
