   (B)   Penalty.
      (1)   Upon conviction of the violation of any provision of this schedule, violators shall be fined in any amount not exceeding the sum of $100 for each occurrence or violation; and the noncompliance with each portion of requirement of this schedule shall constitute a separate offense.
      (2)   In lieu of any person violating a provision of this schedule being charged for such violation in any court of competent jurisdiction for the penalties described in this schedule, in the discretion of the law enforcement officer, Town Marshal, Deputy Marshal or police officer making such charge of violation of this schedule, the person so charged may pay within 72 hours the sum of $25 to the Town Clerk-Treasurer for the benefit of the General Fund of the town. The Town Marshal, Deputy Marshal, law enforcement officer or police officer making such charge of violation of this schedule shall make such decision as to the option to pay the sum for the benefit of the General Fund of the town, in his sole and absolute discretion, and shall inform such person violating this schedule in writing of said decision. Unless the decision to allow the payment of the sum of $25 to the General Fund of the town shall be made in writing as aforesaid and conveyed to the person violating the schedule in such manner, then the person so charged with the violation of this schedule shall be prosecuted in a court of competent jurisdiction for violation of this schedule in the normal manner for prosecution of misdemeanors.
      (3)   If after receipt of such written notice of the right to make a $25 payment to the General Fund of the town in lieu of prosecution, the charged party fails to make payment of said $25 sum within the 72-hour period, then at the option of the Town Marshal or other authorized person, the prosecution of the charged person shall proceed as in the normal prosecution of misdemeanors. In the discretion of the Town Marshal or other authorized person on behalf of the town, the charged party may be required to pay the sum of $25 immediately upon his being informed of the violation of this schedule instead of being granted the period of 72 hours to make payment.
      (4)   The town shall not be limited in pursuing any civil remedy for eliminating or stopping the violation of any provisions of this schedule.
