§ 59.01 DECLARATION.
   The city is expressly authorized to enter into a developer agreement pursuant to the procedure and requirement of G.S. §§ 160D-1001 through 160D-1012 which procedures and requirements include approval of the development agreement by the governing board of the local government (City Council) after a duly noticed public hearing.

§ 59.02 PURPOSE.
   Development projects create community opportunities and impact that often require long-term commitments of both public and private resources. Because of their scale and duration, such projects require careful coordination of public capital facilities, planning, financing, and construction schedules. Local government may enter into development agreements to better manage and structure development approvals while coordinating public facilities.

§ 59.03 DEFINITIONS.
   For the purpose of this chapter the following definitions hall apply unless the context clearly indicates a different meaning.
   CITY. The City of Monroe.
   DEVELOPER. Any per on, firm, partnership, association, corporation, company, or organization of any kind that proposes or conducts development as defined herein.
   DEVELOPER AGREEMENT. A voluntary contract between the city and a developer who owns or controls property within the jurisdiction, detailing the obligations of both parties and specifying the standards and conditions that will govern certain aspects of the development of the property. The agreement guarantees a property owner the right to develop a defined project subject to the terms of the agreement. It provides regulatory certainty, establishes a schedule for development, and coordinates the provision of any public facilities, capacities, etc.
   DEVELOPMENT. Any manmade change to improved or unimproved real estate, including but not limited to: buildings or other structures; filling; grading; paving; excavation; or storage of equipment or materials; the planning for or carrying out of a building activity; the making of a material change in the use or appearance of any structure or property; or the sub-dividing of a parcel of land.
