§ 31.01 COUNCIL.
   (A)   The Council consists of five members and its members shall be elected at large by the voters of the whole town in accordance with I.C. 36-5-2-5, and as adopted herein.
   (B)   The legislative districts of the town have been abolished as provided by the town.

§ 31.02 PARK AND RECREATION BOARD.
   (A)   Under the provisions of I.C. 36-10-3, there is hereby created the Monon Department of Parks and Recreation, operated by a Park and Recreation Board.
   (B)   The Park and Recreation Board shall be composed of:
      (1)   Four members appointed by the Town Council on the basis of their interest in and knowledge of parks and recreation.
      (2)   Additional members shall include one member from the North White School Corporation School Board, who shall be appointed by the School Board, and one member from the Monon Township Public Library Board, who shall be appointed by the Monon Township Public Library Board.
      (3)   No Town Council member may sit on the Park and Recreation Board.
   (C)   (1)   Upon establishment of the Board, the terms of its members shall be as follows:
         (a)   One member for a term of one year.
         (b)   One member for a term of two years.
         (c)   One member for a term of three years.
         (d)   One member for a term of four years.
         (e)   The North White School Corporation appointee shall be appointed annually for the term of one year.
         (f)   The Monon Township Public Library appointee shall be appointed annually for the term of one year.
      (2)   As a term expires, each new appointment shall be made by the Town Council for a four year term. All terms expire on the first Monday in January, but a member shall continue in office until his or her successor is appointed. If an appointment for a new term is not made by the Town Council by the first Monday in April, the incumbent shall serve another term. If a vacancy occurs, the Town Council shall appoint a new member for the remainder of the unexpired term.
   (D)   At its first regular meeting in each year, the Board shall elect a President and a Vice-President. The Vice President shall have authority to act as the President of the Board during the absence or disability of the President. The Board may select a Secretary either from within or without its own membership.
   (E)   The Board shall have the power to perform all acts necessary to acquire and develop sites and facilities and to conduct such programs as are generally understood to be parks and recreation functions. In addition, the Board shall have all the powers and duties listed in I.C. 36-10-3 et seq.
   (F)   The Board shall prepare and submit an annual budget in the same manner as other departments of town government as prescribed by the State Board of Accounts. The Board may accept gifts, donations, and subsidies for park and recreation purposes.
   (G)   The Park and Recreation Board shall have full and complete charge of town parks and recreational property, including but not limited to the park hereby designated to be known and named “The C.M. Homer Memorial Park”. The Board shall have full power to make and enforce the rules and regulations as shall be, in its opinion, necessary for the proper care, improvement, and ornamentation of all parks and recreational property owned or partially owned by the Town of Monon.

§ 31.03 ECONOMIC DEVELOPMENT COMMISSION.
   (A)   There is hereby established a department of economic development for the town, to be controlled by a commission known as the “Monon Economic Development Commission”.
   (B)   The Town Economic Development Commission shall consist of three members, appointed as follows. All successor members shall serve a four-year term.
      (1)   One member shall be selected by the President of the Town Council, who shall be considered the town executive for purposes of this section.
      (2)   One member shall be nominated by the County Board of Commissioners.
      (3)   One member shall be nominated by the Town Council.
   (C)   The terms of office of the members of the Town Economic Development Commission shall begin upon their appointment and continue for:
      (1)   Three years from 2-1-1987, in the case of the member selected by the town executive;
      (2)   Two years from 2-1-1987, in the case of the member selected by the County Board of Commissioners; and
      (3)   One year from 2-1-1987, in the case of the member selected by the Town Council.
   (D)   Successor members shall be selected in the same manner as the original members of the Town Economic Development Commission.
   (E)   The Town Economic Development Commission shall be governed by and conform to the economic development statutes, I.C. 36-7-12-1, as amended, insofar as procedural matters are concerned.
   (F)   The Town Economic Development Commission shall have all the powers provided for at law and specifically those stated in I.C. 36-7-12-8, as amended, as originally enacted by Acts, 1981, Pub. Law No. 309, § 31.
   (G)   Within 30 days of its initial meeting and on January 31 of each subsequent year, the Town Economic Development Commission shall file its report with the Town Council and the State Department of Commerce on the form prescribed by the Department and pursuant to I.C. 36-7-12-36.
