(A) There is hereby established for the town an Ordinance Violations Bureau and the duly elected Clerk-Treasurer is appointed Administrator and Clerk of the Bureau, to hold the office during the term of office.
(B) The Clerk-Treasurer is hereby authorized to accept written appearances, waivers of trial and admissions of ordinance violations to the extent permitted by law.
(C) (1) The Clerk-Treasurer is hereby authorized to assess and collect a civil penalty, as set by Town Council from time to time, from each person who admits a violation of one of the following ordinances:
(a) Ch. 90, Animals, except the fee for reclaiming an animal shall remain, as set by Town Council from time to time;
(b) Ch. 91, Fires;
(c) Section 92.02, Weeds;
(d) Section 70.05, Motor Vehicles; and
(e) Ch. 73, Sch. I, Parking.
(2) Civil penalties shall be paid to, receipted from and accounted for by the Clerk-Treasurer under procedures provided by the State Board of Accounts.
(D) Any person charged with an ordinance violation who does not admit to the violation to the Clerk-Treasurer and does not waive his or her right to trial shall be entitled to a trial before the White Supreme Court or other court before which the violation charged may be pending. A denial may be made in person or in writing to the Clerk-Treasurer.
(E) If any person, upon denying a violation of the ordinance charged or failing to pay the civil penalty for the ordinance violation charged, fails to appear to either admit or deny the charge, the Clerk-Treasurer shall report this fact to the Town Attorney who shall prosecute the alleged violation on behalf of the town.
(F) This section does not apply to any offense involving moving vehicular traffic and/or violation of state motor vehicle laws.
