A. Preparation: On reaching conclusions, informally, as recommended in section 12-2-1 of this chapter, regarding his general program and objectives, the applicant shall cause to be prepared a preliminary plat, together with construction drawings, specifications, and other supplementary material as specified in chapter 5 of this title.
B. Copies Submitted To Plan Commission: Ten (10) copies of the preliminary plat and supplementary material specified shall be submitted to the plan commission with written application for conditional approval at least fifteen (15) days prior to the meeting at which it is to be considered. C. Application For Conditional Approval; Fee:
1. The application for conditional approval of the preliminary plat shall be accompanied by a certified check or money order payable to the village in the amount as specified in the subdivision fee schedule found in the appendix E attached to ordinance 831, on file in the office of the village clerk, to cover the cost of checking and verifying the proposed plat. 2. Upon the acceptance of the application by the plan commission, the secretary shall surrender the check or money order to the village treasurer for deposit in the general fund of the village.
D. Preliminary Plat: The preliminary plat will be checked by the plan commission and the village engineer as to conformity with the general development plan and the principles, standards and requirements set forth in this title.
E. Construction Drawings And Specifications: The construction drawings and specifications will be checked by the village engineer and plan commission for conformity to the preliminary plat and the principles and provisions set forth in this title.
F. Village Board Action: Upon receipt of the report of the plan commission, the village board shall either accept or reject the preliminary plat. Such action shall be taken within sixty (60) days after the first regular meeting of the village board following receipt of the plan commission's report.
G. Notify Subdivider Of Conditions Of Approval: The subdivider shall be notified in writing of any conditions of such conditional approval or the reasons for rejection.
H. Approval Of Construction Drawings And Specifications: Such conditional approval of the preliminary plat of the subdivision by the village board shall include approval of the construction drawings and specifications.
I. Entitlement To Final Approval: Conditional approval of the preliminary plat, which includes the subdivision construction drawings and specifications, shall entitle the subdivider to final approval of the layout shown by such plat if the final plat conforms substantially to said plat and any and all conditions of approval have been met and it complies with all applicable village ordinances. The final plat will not be considered until all improvements are constructed and approved by the village.
J. State Permits Required: The subdivider shall obtain the necessary permits from the appropriate agencies of the state, as an agent of the village, upon specific authorization.
K. List Of Existing Covenants: The subdivider shall provide a complete listing of all existing covenants which apply to the land to be subdivided, and a complete listing of all covenants which are proposed by the subdivider to apply to the subdivided land.
L. Tentative Approval: Tentative approval shall be effective for not more than twelve (12) months following the date of conditional approval, unless by mutual agreement between the subdivider and village board this time limit is extended in writing.
M. Action Of Village Engineer: Whenever any action or recommendation is requested of the village engineer by subdividers, or other parties, exclusive of members of the village board of trustees, the village engineer shall obtain the approval of the plan commission prior to providing any such action or recommendation.
