7-1-1: DRAINAGE DITCHES, WATERWAYS AND CULVERTS:
   A.   New Construction: Whenever unimproved property adjacent to and abutting on a village street or roadway is improved by the owner, and there is no existing curb and gutter connected to a storm sewer or to a ditch or waterway for drainage of water, the property owner shall be required to take the following action:
      1.   Install a drainage ditch or waterway if none exists at the time of the improvement, to drain surface water, according to specifications to be established for the site as provided hereafter; or
      2.   Improve any existing drainage ditch or waterway to conform to specifications to be established for the site by the village as provided hereafter; and
      3.   Install a culvert for any driveway crossing such drainage ditch or waterway, according to specifications to be established by the village as provided hereafter.
   B.   Field Entrances: Whenever the owner of property adjoining and abutting on a village street or roadway desires to provide an entrance to said property crossing an existing drainage ditch or waterway, said property owner must install a culvert in accordance with specifications to be established for the site by the village as provided hereafter.    C.   Existing Drainage Ditches, Waterways And Culverts:
      1.   Permit Required To Move Or Replace: Whenever a property owner owning property adjoining or abutting on a village street or roadway, on which there is an existing drainage ditch or waterway and/or driveway culvert desires to replace, change or move said drainage ditch or waterway or replace or move said culvert or eliminate said drainage ditch by the installation of new culvert, said property owner shall obtain a permit prior to initiating such work as provided hereafter.
      2.   Stormwater Collection: Where new culvert is to be installed to eliminate the existing drainage ditch, positive drainage shall be maintained from the roadway to the road right of way. In no instance shall stormwater runoff be allowed to flow from private property across the road right of way onto the roadway pavement. A minimum of one stormwater inlet shall be required to collect stormwater runoff from private property and the road right of way. Additional inlets may be required if considered necessary by the village. Culvert size shall also be determined by the village and is to be installed according to village specifications.    D.   Replacement At Village Request: Whenever the village requires the replacement or relocation of any drainage ditch, waterway or driveway culvert presently existing along a village street or roadway, in order to improve drainage or provide for drainage of water, the village and the adjoining property owner shall share equally in the cost thereof. In the event that such replacement or relocation of a drainage ditch or waterway or culvert is required by improvements undertaken by the village, other than for improving water drainage, the village shall pay the entire cost thereof.
   E.   Application For Permit; Fee:
      1.   Contents Of Application: Prior to the installation, replacement or relocation of any drainage ditch, waterway or driveway culvert as provided in subsections A, B and C of this section, the property owner shall make application with the village clerk for a permit for such work. Applications shall be on forms to be provided by the village and shall contain such information as required by the village.
      2.   Inspection Fee: An inspection fee of ten dollars ($10.00) shall be paid at the time of application.
      3.   Review Of Application: As soon as reasonably possible after filing of an application, the village shall cause the application to be reviewed and the site inspected and specifications as to the size, location and installation of the drainage ditch, waterway, and/or culvert shall be furnished to the property owner and a permit shall be issued allowing the property owner to proceed with such work.
      4.   Compliance With Specifications: All work performed under the permit shall be in accordance with Village specifications provided the property owner.
      5.   Right To Reject Application: The Village reserves the right to reject any application which is determined by the Board of Trustees to be detrimental to the welfare, health or safety of the residents of the Village. (Ord. 615, 12-10-1986)
      6.   Culvert Permit Required:
         a.   Application: A culvert permit application and supporting information must be filed with Monee for review and approval prior to installation of a culvert in a Monee right-of-way. Said culvert permit application is available at the Village Hall.
         b.   Fees: The required fees noted on the culvert permit application shall be paid for by the applicant or their designated representative prior to review of the application by Monee.
         c.   Application Approval: No work shall commence relative to installation of a culvert in a Monee right-of-way until the culvert permit application has been signed and dated approved by Monee.
         d.   Work To Be Completed: All work associated with the culvert installation shall be completed as represented by the approved culvert permit application and supporting information.
         e.   Inspection: Monee may inspect the culvert installation as deemed necessary to verify the work is performed in accordance with the approved culvert permit application.
         f.   Timely Completion; Extension: The culvert installation shall be satisfactorily completed by the applicant and the permit application subsequently signed and dated as inspected by Monee within one (1) year of the approval date of the permit unless an extension is granted in writing by Monee.
         g.   Penalties: Any contractor, developer, subdivider or builder who is found to be in violation of this subsection E6 shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) per offense. A separate offense shall be deemed to be committed for each day that a violation exists. In addition to the monetary penalties, the Village shall have the right to rescind any building permit that may have been issued in connection with a development. (Ord. 1388, 3-22-2006)
   F.   Maintenance Required: The owners of property adjoining and abutting on the right-of-way of any Village street or roadway in which there presently exists or in which there is hereafter installed a drainage ditch or waterway or driveway culvert, shall be required to maintain such drainage ditch or waterway or culvert in an operating condition free of obstructions.
   G.   Obstructions: No person shall dump any leaves, trash, soil or other material into any such drainage ditch, waterway or culvert, and no person shall obstruct same. No railroad ties, stones or other materials which may obstruct the flow of water, or hinder cleaning the ditch or snow removal by the Village shall be placed in said drainage ditch, waterway or culvert or elsewhere in the public right-of-way.    H.   Penalty: Any person violating any provision of this section shall, upon conviction, be subject to penalty as provided in section 1-4-1 of this Code. Each day such violation shall continue shall constitute a separate violation. (Ord. 615, 12-10-1986; amd. 1999 Code)
