9-5-3: PRIVACY FENCES:
   A.   Application Of Provisions: As used in this chapter, privacy fences shall apply to fences placed between commercial and existing residential areas (not residential and commercial zones as defined by city ordinances 1 ). Privacy fences shall be placed at the expense of the business at any location where a new commercial business is being established or where any existing business is expanding, remodeling or relocating in any way or if such businesses and/or parking lots associated therewith come within thirty three feet (33') of abutting existing residential property.
   B.   Location: Privacy fences shall be placed at a location and in an manner as to screen the expansion or new location of the business from all existing residential property abutting within thirty three feet (33') of the existing commercial property.
   C.   Height And Materials: Privacy fences shall be of a six foot (6') minimum and eight foot (8') maximum height. The material of which said privacy fences shall be constructed shall be subject to approval by the city council and shall not be of a type that is not appealing to the eye or of which will devalue the abutting property. The construction of privacy fences shall be in a manner and of a material that will confine and restrict the blowing of garbage and trash and to minimize reflection of vehicle headlights on the abutting residential property.
