Any person who believes he or she has been aggrieved by an action of the fire marshal which is adverse to the interests of such person, such person may appeal the decision of the fire marshal to the Mitchell city council by filing a statement written in plain language with the city finance officer, stating the action from which the appeal is taken within ten (10) days of receiving written notification of adverse action from the fire marshal as provided in the preceding section of this chapter. The appeal shall be heard by the Mitchell city council in regular or special session within forty five (45) days of the receipt of such appeal by the city finance officer. Notice of hearing on such appeal shall be given to the person making the appeal in the manner as notice of adverse action as provided in section 9-1-9 of this chapter at least ten (10) days prior to the date set for such appeal hearing.
