A. Notwithstanding any defects or irregularities, all acts and proceedings taken by the utility department and its agents, or purportedly had or taken under law or under color of law by them, in fixing, imposing and collecting the rates, tolls, charges, liens, deposits, penalties and other rules and regulations provided for by former enactments and amendments of this title, prior to the enactment of this amended title, and all actions and proceedings are hereby validated, ratified, approved and confirmed.
B. In the event any provision of this title shall be deemed to be unlawful by a court of competent jurisdiction, the invalidity of such section shall not affect the remaining sections. (MC Ord. 192A § 1, 2006)
