6.04.330: ARRESTS:
If any person is arrested without a warrant for violation of any provisions contained in this chapter, the arresting officer may take the name and address of such person and notify him in writing to appear before a justice of the peace at a time and place to be specified in such writing but not sooner than three (3) nor more than ten (10) days subsequent to the date of such arrest; except that if the person so arrested so demands, he shall be taken forthwith before a justice of the peace. Upon serving a summons in writing to such person, the officer may forthwith relinquish him from custody. It is unlawful and punishable as a misdemeanor for any person wilfully to fail to appear at the time and place directed by such summons. (MC Ord. 102A § 2, 1986)
